تعهد دولت به حمایت از حقوق بشر: ضرورت طرح مسئولیت کیفری شرکتها در قبال نقض حقوق بشر در نظامهای حقوق داخلی

چکیده
|
افزایش نقش و ظرفیت شرکت ها و موسسات مالی و اقتصادی، بهویژه شرکتهای بسیار بزرگ و فراملی در دنیای امروز از یکسو و مداخله آنها در اموری که پیشتر در حوزه صلاحیت انحصاری دولتها قرار داشته است از سوی دیگر، نقض حق های بشری توسط این شرکت ها را به یکی از دغدغه های مهم حقوق بشر بینالملل تبدیل نموده است. حقوق بشر بینالملل نیز برای مقابله با این نگرانی تعهد دولتها به حمایت از حقوق بشر در برابر موارد نقض آن توسط اشخاص ثالث ازجمله شرکتها را بهرسمیت شناخته است؛ درواقع، دولتها متعهد هستند تا با استفاده از کلیه ابزارهای مناسب بهویژه ابزارهای حقوقی، با نقض حقوق بشر توسط اشخاص ثالث مقابله نمایند. متاسفانه، بررسی نظامهای حقوقی مختلف حاکی از آن است که حقوق جزا بهعنوان یکی از مهمترین شاخههای حقوق داخلی چندانکه بایسته است، بهمنظور ایفای تعهد دولت به حمایت، موردِاستفاده قرار نگرفته است. در این نوشتار تلاش شده، اثبات شود که پذیرش مسئولیت کیفری شرکتها و جرمانگاری نقض حداقل برخی از حقوق بنیادین بشر توسط شرکتها و بهرهگیری از ابزارهای حقوق جزا برای تعقیب و مجازات شرکتهای مرتکب نقض حقوق بنیادین بشر، برای ایفای تعهد بینالمللی دولت به حمایت از حقوق بشر ضروری است.

State Duty to Protect Human Rights:The Necessity of Acceptance of Corporate Criminal Responsibility for Human Rights Violations in National Legal Systems

Abstract
|
Ascending role and potential of corporations and financial institutions, specifically transnational corporations in today world in one side, and their influence on affairs which were previously were considered as the sole competence of states in the other, have provoked serious human rights concerns about corporate human rights’ violations. In order to respond to said concerns, the sate duty to protect human rights against third parties’ interference (including corporations) has been recognized by international human rights law. Therefore, by employing all appropriate measure particularly legal initiatives, states have duty to battle human rights violations. Unfortunately, review of different national legal systems reveals that criminal law, as one of the most important parts of national legal system has not been properly utilized in order to fulfill the state duty to protect human rights. The present article endeavor to prove that acceptance of corporate criminal liability, criminalization of corporate violations of, at least, the most fundamental human rights and also take advantage of criminal law measures are inevitable for convenient fulfillment of state duty to protect of human rights.
