مشارکت سازمان‌‌‌های ‌‌بین‌المللی در تحقیقات مقدماتی ‌‌دیوان کیفری ‌بین‌المللی

سازمان‌‌های ‌‌بین‌المللی به‌عنوان یکی از تابعان کارآمد حقوق ‌‌بین‌الملل در مسائل مختلف ‌‌بین‌المللی کارکردهای متنوعی دارند. با تاسیس ‌‌دیوان کیفری ‌بین‌المللی، مشارکت سازمان‌ها در تضمین تحقق عدالت کیفری متحول شده است. مشارکت سازمان‌های ‌‌بین‌المللی در روند دادرسی از طریق ارایه اطلاعات یکی از سازوکارهایی است که می‌تواند در تحقق عدالت کیفری تاثیرگذار باشد. هدف این مقاله بررسی امکان تاثیر نقش سازمان‌های بین‌المللی در تحقق عدالت کیفری بین‌المللی است و با روش توصیفی و تحلیلی و با استناد به رویه قضایی دیوان، در مقام پاسخ به این چند پرسش است: سازمان‌های بین‌المللی در مرحله تحقیقات مقدماتی در شروع به تعقیب کیفری چه نقشی دارند؟ سازوکارهای مشارکت سازمان‌های بین‌المللی در نظارت بر تصمیمات قضایی دادستان چگونه است؟ با فرض پذیرش مشارکت، این نهادها در تحقق عدالت کیفری بین‌المللی چه نقشی ایفا می‌کنند؟ یافته‌های این تحقیق نشان می‌دهد مشارکت سازمان‌های بین‌المللی در مرحله تحقیقات مقدماتی در اقدامی ‌نوآورانه، در قواعد دیوان پیش بینی شده است. سازمان‌های ‌‌بین‌المللی از یک سو، با ارایه اطلاعات به دادستان، تعقیب کیفری را به جریان انداخته و زمینه بررسی مقدماتی را فراهم می‌سازند و ازسوی دیگر، زمینه‌های نظارت قضایی در تصمیمات دادستان مبنی برآغاز یا عدم آغاز تحقیق را ایجاد نموده و زمینه تحقق عدالت کیفری بین‌المللی را فراهم می‌کند.

International Organizations Participation in Preliminary Examination in International Criminal Court

Abstract International organisatinos as one of the effective subjects of international law have varied functions in different international issues. Organisations participation in ensuring realization of criminal justice has been evolved with establishment of International Criminal Court. International Organisations participation in trail procedure by providing informations is one of the mechanisms that can be effective in realization of criminal justice. This article aims to study the feasibility of effect of international organisations in fulfilment of international criminal justice. with descriptive analytical method and by reference to court jurisprudene it answers to this questions: what is the role of international organisations to initiate of the criminal procedure in preliminary examination phase? How is the participation mechanisms of international organisations in judicial review in Prosecutor’s decisions? And assuming this participation, what is the role of this organs in fulfilment of international criminal justice? The results of this study show that the rules of Court in innovative manner has provided the International Organisations participation in preliminary examination phase. At this phase, on one hand International Organisations trigger the prosecution and prepare the basis of preliminary examination by providing informations, and on the other hand, establish the basis of judicial review in Prosecutor’s decisions to proceed or not to proceed the investigation. This article studies how organisations can affect the trigger of prosecution and judicial review in Prosecutor’s decisions at preliminary examination.
