رویکرد اسناد بین‌المللی به حقوق بزه دیدگان جنایت ناپدید سازی اجباری

ناپدید سازی اجباری ازجمله جنایت‌های مستمر و مرکب علیه بشریت است که آزادی‌های فردی را خدشه‌دار نموده و بزه دیده را از حق برخورداری از حمایت‌های قانونی محروم می‌دارد، اغلب این محرومیت‌ها درنهایت منتهی به قتل یا آزار و اذیت روحی و جسمی افراد می‌گردد. در طول زمان نمونه‌های بارزی از این جنایت را شاهد بوده‌ایم که اغلب به سبب مسائل سیاسی، مذهبی یا نژادی ارتکاب یافته است. با توجه به عمق خسارات وارد آمده به بزه دیده این جنایت، سازمان و نهادهای حقوق بشری را بر آن داشت تا علاوه بر توجه به حقوق بزه دیدگان این جنایت در اسناد و اساسنامه‌های خود، راه‌های مقابله با آن را نیز در پیش گیرند و حداقل حقوق از دسته رفته بزه دیدگان را به آنان بازگرداند. اهمیت جنایت ناپدید سازی اجباری، دغدغه تعیین سرنوشت قربانیان این جنایت را در هر شخص عادی نیز به وجود می‌آورد ولی گرچه در محافل بین الملل این جنایت موردتوجه قرار گرفته اما در حقوق داخلی کمتر موردتوجه بوده و ضمانت اجرای موثری برای آن تعیین نگردیده است.

The International Documentary Approach to the Victims of the Crime of Forced Disappearances

Compulsory disappearance is a Continuous and Combined crime against humanity that undermines individual freedoms and deprives the victim of the right to legal protection, mostly these deprivations ultimately lead to the killing or physical and psychological harassment of individuals. Over time, we have seen many examples of this crime, which has often been committed by political, religious or racial issues. Given the depth of the damage done to the victim of this crime, the human rights organization and institutions have made it, in addition to paying attention to the rights of the victims of this crime, in its documents and treaties, ways to deal with it and return them at least the rights of the victimized group. The importance of the crime of forced disappearance, perpetration of this crime is also a matter of concern for every ordinary person, therefore, in this research, we tried to emphasize the descriptiveanalytical method and the use of library resources while expressing the concept of the disappearance of the rights of the victims of the crime.
