بررسی مبانی و ادله دام‌گستری در متون دینی

از موضوعات مهم در حقوق کیفری، مساله کشف و اثبات جرم و تحصیل دلیل از طریق مشروع و قانونی است به‌گونه‌ای که مهم‌ترین دلیل در کشف و اثبات یک واقعه مجرمانه چنانچه در تحصیل آن ضوابط قانونی لحاظ نشود، فاقد اعتبار است. هدف ما در این نوشتار این است که اولاً عدم رعایت اصل مشروعیت دلیل و مقدمات آن می‌تواند ادله تحصیلی را در معرض بی‌اعتباری قرار دهد. ثانیاً چنانچه پلیس از شیوه‌های متعارف نتواند با جرائم پیچیده و سازمان‌یافته و امنیتی برخورد کند، می‌تواند به شیوه دام‌گستری عمل نماید؟ سوال این است که در صورت لزوم با چه توجیه شرعی و قانونی می‌تواند اقدام نماید؟ آیا فقه امامیه پاسخگوی این سوال هست؟ در اینجا ما با مطالعه منابع موجود و بررسی ادله و تاسیس اصل قانونی بودن تحصیل دلیل، به این نتیجه می‌رسیم که فقط در برخورد با دشمنان و مجرمین حرفه‌ای و امنیتی این هم تا رفع ضرورت می‌توانیم به این شیوه عمل کنیم و در سایر موارد مجاز به دام‌گستری نیستیم. پس اصل عدم مشروعیت دام‌گستری است، مگر در موارد خاص و استثنائی که در این مقاله به آن می‌پردازیم.
