حق بر شادی

شادی برای بیشتر انسان های مضطرب امروز که در غصه نداشته ها، کمبودها و فرصت های از دست رفته بسر می برند و خود را در میان انواع آلودگی های زیست محیطی، بیماری‎های عالم‎گیر و چالش‎های مرتبط با وضعیت اقتصادی می بینند یک نیاز و ضرورت است.   انسان ها محق به شاد زیستن هستند. این پژوهش جهت تشریح حق بر شادی (right to happiness) به عنوان حقی مشترک میان حقوق بشر و حقوق شهروندی، مفهوم شادی را تبیین و مبانی نظری و حقوقی آن را بیان کرد. سپس نگاه قوانین ایران و اسناد بین الملل به شادی را مورد بررسی قرار داد با این پرسش که قوانین ایران، آن را به عنوان یک حق به رسمیت شناخته اند؟ به چه میزان اسناد بین المللی به حق شادی انسان ها توجه نموده اند؟ فرضیه پژوهش این بود که قوانین ایران به طور پراکنده به شادی و نه به عنوان یک حق پرداخته اند و ضعف در این زمینه بیشتر در رفتار و عملکردها وجود دارد. حق بر شادی در اسناد بین المللی به صورت موردی و با پرداختن به حقوق سیاسی، اقتصادی، اجتماعی و فرهنگی مورد توجه قرار گرفته است.

Right to Happiness

Happiness for anxious people of today, who are in grief for deficit  and missing opportunities and lives in a variety of environmental pollution, are necessary. Human entitled to live happily. This Article seeks to define the concept of happiness in order to explain the citizens happiness right as a common right between human rights and civil rights, and explicated its theoretical and legal foundations, then examined the right of happiness in Iran’s laws and international documents with the question that what the value of happiness in Iran’s laws is? and is it recognized as a right? How much international documents have paid attention to human happiness? The research hypothesis was Iran’s laws have not considered happiness properly and there is a lack of legislation and more in the function of the authorities. The Right of Happiness in International documents is almost regarded to political, economic, social and cultural right.
