زمینه‌ها و عوامل رواج و بومی‌سازی فقه مالکی در اندلس

شکل‌گیری و رواج اندیشه‌های دینی و اجتماعی یکی از مهم‌ترین موضوعات مورد بررسی پژوهشگران حوزه تاریخ و تمدن بوده است. موضوع این پژوهش زمینه‌ها و عوامل ورود فقه مالک به اندلس و بومی‌سازی آن بر اساس بافت اجتماعی آن است. از زمینه‌های ورود فقه مالکی به اندلس می‌توان به مرجعیت فقهی و حدیثی بوم مدینه در سرزمین‌های اسلامی در سده دوم و ترکیب جمعیتی اهالی اندلس اشاره کرد. یافته‎‌ها حاکی است که عواملی چون حمایت حکومتی امویان اندلس از فقه مالک، اهتمام فقهاء به رواج این فقه، سفرهای زیارتی و رحله‌های حدیثی اهالی اندلس به حجاز؛ منجر به بومی‌سازی فقه مالک در  بافت اجتماعی اندلس گردید. در واقع فقها در چهارچوب فقه مالک در بافت اجتماعی اندلس از آرای فقیهان دیگر همچون اوزاعی، لیث بن سعد و شافعی تاثیر پذیرفته و اقدام به بومی‌سازی فقه مالکی نمودند.

the formation and expanding of religious and social thoughts has been one of the most important subject investigated by researchers in the field of history and civilization. the subject of these research is the fields and  factors of maliki  jurisprudence entering andalusia and its localization according to its social field. among the fields for maliki jurisprudence  enterence in andalusia, we can indicate to  jurisprudence and hadith authority of medina in the islamic lands in the second century and the population composition of andalusian people. the  research findings indicate that factors such as the support umayyad government of the  andalusia to malik’s jurisprudence, the jurists emphasis to expanding this jurisprudence, pilgrimages and hadith journeys of andalusian people to hejaz;  led to the localization of malik’s jurisprudence in the social contex of andalusia. in fact, the jurists in the framework of malik’s jurisprudence in the social context of andalusia were influenced by the ideas of other jurists such as uza’i, laith bin saad and shafi’i; and they tried to localize maliki jurisprudence.
