ملاک بهره مندی اهل بیت(ع) از نتایج فتوحات

فتوحات وجنگ هایی که پس از رحلت پیامبر| رخ داد و منجر به گشوده شدن دروازه های ایران و روم شرقی و آفریقا گردید متفکران و عالمان مسلمان را با پرسش هایی مواجه کرده است پرسش هایی مانند این که آیا فتوحات مشروعیت داشته اند؟ در صورت عدم مشروعیت این رویداد؛ ملاک بهره مندی اهل بیت^ از نتایج آن چه بوده است؟ و آیا اصولاً می توان میان عدم مشروعیت یک عمل و نتائج آن تفکیک کرد؟ در این نوشتار به این نتیجه رسیدیم که با توجه به مشروط بودن مشروعیت جهاد ابتدایی در فقه شیعه به اذن امام یا نایب خاص امام و فقدان شرط مذکور در فتوحات پس جنگ های مذکور مشروع نبوده اند، مع الوصف اهل بیت از نتائج فتوحات، استفاده برده اند؛ ملاک بهره مندی مذکور یا به عنوان انفال بوده و یا بر پایه قاعده الزام به عنوان سهم ذوی القربی از خمس بوده است.

The Criterion for the Enjoyment of Ahl al-Bayt from the Results of the Conquests

After the demise of the holy Prophet (PBUH), conquests and wars which led to the opening of the gates of Iran, Byzantine Empire and Africa challenged Muslim thinkers and scholars to ask questions such as whether these conquests were legitimate. If they were illegitimate, what would be the criterion for the enjoyment of Ahl alBayt from these results? And can one distinguish between the lack of legitimacy of an action and its outcome? In this paper, we concluded that given the conditionality of the legitimacy of the primary jihad in Shiite jurisprudence by the permission of the Imam (AS) or the special vice of the Imam and the lack of the condition mentioned in the conquests, these wars were not legitimate. However, Ahl alBayt have benefited from the results of the conquests. The criterion for such an enjoyment was either the spoils or was based on the rule of obligation refereeing to the share of close relatives from khums.
