تقابل یک‌جانبه‌گرایی و حاکمیت قانون در حقوق بین‌الملل؛ مطالعه موردی: تحریم‌های آمریکا علیه ایران

بحث »چالش‌های فراروی حاکمیت قانون در مواجهه با یک جانبه‌گرایی در حقوق بین‌الملل « که در این مقاله به روش توصیفی، تحلیلی از منابع کتابخانه‌ای و اسنادی، مجال سخن یافته است یکی از موضوعات مهم روابط و حقوق بین‌الملل را تشکیل می‌دهد و قصد دارد به این سوال اساسی پاسخ دهد که تحریم‌های یک‌جانبه آمریکا علیه کشورها و به‌خصوص ایران، چه چالش‌هایی با حقوق بین‌الملل دارد؟ و آیا این اعمال یک‌جانبه از منظر حقوق بین‌الملل معتبر و مشروع هستند؟ و همچنین از منظر حقوق توسل به زور، آیا ایالات متحده به بهانه دفاع مشروع، حق حمله به کاروان حامل سردار سلیمانی در حوالی فرودگاه بغداد را داشته است؟ داده‌ها حاکی از آن است که از سال 2002 مسئله تحریم ایران از سوی آمریکا و غرب به مثابه چالشی اساسی میان ایران و غرب مطرح بوده و هست. اجرای یک ‌جانبه تحریم‌های آمریکا، بدون وجود مجوز قبلی شورای امینت و خارج از سیستم امنیت جمعی منشور باعث گردیده تا مشروعیت این اقدامات از حیث انطباق آنها با موازین حقوقی بین‌المللی زیر سوال رود و مغایر با اصل حاکمیت قانون در سطح بین‌المللی نیز می‌باشد و در خصوص حرکت اخیر این کشور مبنی بر ترور فرمانده سپاه قدس ایران نیز می‌توان گفت که به موجب ماده 51 منشور و رویه دیوان بین‌المللی دادگستری، دفاع مشروع باید در پاسخ به »حمله‌ای مسلحانه « باشد که در قضیه مورد بحث وجود ندارد.
