analysis of interpol's operational challenges in implementing red notices in the extradition of terrorism suspects

Abstract    background and objective: in the post 9/11 security architecture, interpol's red notice has become a vital instrument for the extradition of offenders. however, its application in politically sensitive and ambiguous terrorism cases has created a fundamental tension between urgent security imperatives and human rights obligations. the primary aim of this study is to examine the structural conflict between interpol's operational logic (based on speed and trust) and the fundamental rights of suspects, while critically assessing the effectiveness of existing oversight mechanisms in safeguarding the right to a fair trial. method: this research employs a descriptive–analytical method with a qualitative approach. data were collected through library and documentary research. the corpus includes primary legal instruments such as interpol's constitution and data processing rules, reports of the commission for the control of files, un resolutions, and documentation from international human rights organizations. authentic sources were used to ensure validity, and reliability was secured through cross referencing multiple sources. data were analyzed using logical reasoning, and the operational mechanisms of red notices were evaluated against human rights principles. findings: the study reveals that the current structure of issuing red notices, which relies on the presumption of accuracy of member states' information, systematically undermines the presumption of innocence in terrorism cases. it does so by generating global stigmatization effects and imposing severe financial and travel restrictions prior to the establishment of guilt. furthermore, the analysis shows that recent structural reforms, although enhancing the role of the commission for the control of files, remain ineffective in preventing political misuse and transnational repression. this is due to their ex post facto nature (review after violations occur), the informational asymmetry between individuals and states, and most critically, the absence of binding enforcement mechanisms for deleting data from national databases. conclusion: the innovation and final argument of this study is the necessity of moving beyond the current post violation compensation model. sustainable judicial security within interpol can only be achieved through the establishment of an independent quasi-judicial review mechanism prior to the issuance of red notices. this strategic shift — relocating oversight from the post publication stage to the pre-publication stage — would prevent the globalization of unjust national judicial rulings and safeguard interpol's international legitimacy.
