Abstract
background and objective: in the course of attacks on the gaza strip and other occupied territories, the zionist regime has, for more than 75 years, committed unprecedented international crimes in history. post–world war ii developments and shifts in certain classical approaches to the international responsibility of states led to the identification of new forms of international responsibility, among which aggravated responsibility is included. this study seeks to examine the conceptual framework of this notion in international law, with particular emphasis on the case of the zionist regime.method: the present research has been conducted through a descriptive–analytical approach based on documentary review, with all data collected from written sources and authoritative documents. data analysis has relied on legal reasoning and the simultaneous comparison of international instruments, judicial decisions, and doctrinal perspectives. the scientific validity of the study has been ensured through internal consistency of the content and external verification of findings against judicial practice and the principles of international responsibility.findings: : members of the international community bear specific obligations under international law in relation to the zionist regime's attacks on gaza, as the continuous and grave violation of a peremptory norm—one that has attained the status of a universally binding rule—has deeply affected the international community.conclusions: under international law, palestine possesses the inherent right of self-defense as explicitly stipulated in the charter of the united nations. beyond the usual consequences—cessation, guarantees of non-repetition, and reparation—it is necessary to take into account the consequences arising from the commission of international crimes in this regard. such acts themselves constitute a serious breach of a peremptory norm, as articulated in the 2001 articles on responsibility of states for internationally wrongful acts of the international law commission, and as reflected in judicial practice and doctrinal discourse.
