absolute criminal liability of police: foundations and manifestations (with reference to international instruments)

Abstract    background and objective: owing to the multiplicity of missions and statutory responsibilities, faraja (iran's national police organization) is frequently exposed to numerous allegations and, as a legal entity, must be accountable for its decisions. the purpose of this study is to examine the theoretical foundations and implications of abstract (absolute) criminal liability within faraja as a juridical person.method: this research is based on library and documentary studies and employs a descriptive–analytical approach. data have been extracted from statutes, legal doctrine, and judicial practice. the analysis relies on legal reasoning and interpretation of theoretical foundations to clarify the framework of absolute criminal liability applicable to faraja.findings: the abstract criminal liability of faraja can be aligned with established theories, particularly vicarious liability, secondary personality, and the directing mind doctrine. moreover, the review of practice and regulations indicates that the absence of an effective internal control system increases the likelihood of attributing individual errors to the legal personality of faraja, thereby playing a significant role in shaping absolute liability.conclusion: criminal liability of legal persons, as explicitly provided in article 20 of the islamic penal code, constitutes an exception to the general principle of non-liability of such entities, and faraja falls within this rule. multiple foundations for abstract (absolute) criminal liability have been identified, both in general terms (applicable to public employees and governmental organizations) and in specific terms (applicable to faraja and police officers). accordingly, the scientific bases of absolute liability for faraja include vicarious liability, secondary personality, and the directing mind theory. although critics have raised objections to the notion of absolute liability for faraja — such as the absence of intent and will, and disregard for the principle of personal responsibility — these objections, in light of five arguments advanced in this study, are not decisive. the manifestations of absolute criminal liability for faraja, given its statutory duties and diverse policing missions, primarily encompass liabilities arising from accidents and officers' use of firearms.
