Abstract
background and objective: the principle of non refoulement is one of the fundamental norms of international refugee law and international human rights law, prohibiting states from returning individuals to territories where they face the risk of torture, persecution, or serious threats. although this principle has been recognized as customary international law — and, according to some jurists, even as a peremptory norm (jus cogens) — its implementation in airport transit zones continues to encounter legal and institutional challenges. the aim of this study is to analyze the legal status of these zones in order to clarify the application of the principle of non refoulement, with particular emphasis on the role of police in ensuring its enforcement.method: the present research is fundamental–applied in nature and has been conducted using a descriptive–analytical method. data have been collected through the study of international instruments, including the 1951 refugee convention, the chicago convention (1944), judgments of the european court of human rights and the court of justice of the european union, as well as reports of the united nations high commissioner for refugees and the european union agency.findings: the findings show that airport transit zones are considered part of the state's territory, and the principle of non refoulement applies within them. the police, as the first executive authority encountering asylum seekers, play a key role in ensuring the implementation of this principle.conclusion: based on the findings of this study, it can be concluded that no state or border authority may evade its obligations toward asylum seekers by invoking the notion of an international zone. the effective implementation of the principle of non refoulement requires systematic cooperation among police, judicial, and asylum authorities, as well as the enhancement of specialized police training.
