معیارهای تاثیر گذار بر الگوی فکری قضات دیوان بین المللی دادگستری

زمینه و هدف: دیوان بین المللی دادگستری به عنوان رکن فضایی سازمان ملل متحد و یک مکانیزم صلح ساز وظیفه حل و فصل اختلاف میان دولتها را بر عهده دارد. لذا شناخت پیرامون نحوه تصمیم گیری و آنچه که بر تصمیمات قضات دیوان تاثیر می گذارد از اهمیت بسیاری برخوردار است. لذا در این پژوهش ضمن بررسی مفهوم الگو به این امر می پردازیم که چه الگو و معیارهایی بر تصمیما قضات دیوان تاثیرگذار است؟روش: این مقاله به شیوه توصیفی- تحلیلی نگارش یافته است.یافته ها و نتایج: الگو به معنای مدل شامل دو جنبه داخلی و بیرونی است که الگوی بیرونی دارای معیار قانونی و راهبردی است. الگوی درونی به دو بخش کلی یعنی الگوی نگرشی و ویژگی های شخصیتی قضات تقسیم می گردد. در کنار اصول معیارهای دیگری نیز بر الگوی فکری قضات دیوان بین المللی دادگستری از جمله معاهدات، قواعد عرفی بین المللی (سنتی و مدرن) و تصمیمات قضایی تاثیرگذار است. همچنین قضات دیوان از روش های تفسیری متنی، سیستماتیک (یا مفهومی) ، هدفمند ( غایت شناختی) و تاریخی استفاده می نمایند. پیرامون تاثیر سیاست قضایی دیوان بین المللی دادگستری در الگوی قضات می توان به جایگاه دیوان بین المللی دادگستری در اعمال اقتدارات دیوان، اهداف و اصولی که دیوان در سیاست های خود مد نظر قرار می دهد وتاثیر ویژگی حقوق بشری قضایا در سیاست قضایی دیوان اشاره نمود. به علاوه پیرامون تعارض رویه دیوان با سایر محاکم بین المللی باید گفت که بطور سنتی دیوان بین المللی دادگستری از استناد به رویه قضایی سایر محاکم بین المللی خودداری می کند، اما در عوض به رویه قضایی خود استناد می نماید.

findings and conclusion: the model means the model includes two internal and external aspects, and the external model has a legal and strategic criterion. the internal model is divided into two general parts, namely, the attitude model and the personality characteristics of judges. in addition to the principles of other criteria, it also affects the thinking pattern of judges of the international court of justice, including treaties, international customary rules (traditional and modern) and judicial decisions. regarding the mental model of judges in the face of legal vacuum, it should be said that judges have discretionary powers. also, the judges of the court use textual, systematic (or conceptual), purposeful (or teleological) and historical methods of interpretation. the international court of justice also interprets judicial decisions in two formal and informal ways. regarding the impact of the judicial policy of the international court of justice on the model of judges, it is possible to point out the position of the international court of justice in exercising the authority of the court, the goals and principles that the court considers in its policies, and the effect of the human rights nature of the cases in the judicial policy of the court. in addition, regarding the conflict of the court's procedure with other international courts, it should be said that traditionally the international court of justice refrains from referring to the jurisprudence of other international courts, but instead refers to its own jurisprudence.
