واکاوی دیپلماسی پلیسی در اینترپل با تاکید بر استرداد مجرمان

زمینه و هدف: امروزه یکی از اهداف توسعه دیپلماسی پلیسی در پهنه بین المللی، استراد مجرمین و پاسخگو کردن افرادی است که مرتکب بزه شده و از کشور محل وقوع بزه متواری شده اند. در این راستا، هدف اصلی مقاله، واکاوی روند توسعه دیپلماسی پلیسی در اینترپل با تاکید بر استرداد مجرمان و شناسایی چالش های پیش روی آن است.روش: با توجه به ماهیت و موضوع پژوهش برای تدوین این اثر از روش مطالعات تحلیلی توصیفی یاری گرفته شده است و تلاش شده است که در چارچوب روش شناسی کیفی به تحلیل موضوع پرداخته شود.یافته ها و نتایج: استرداد مجرمان در اینترپل به مثابه روشی برای ایجاد نظم حقوقی در روابط بین الملل مورد توجه است. اما آن چه مهم است؛ با وجود ضرورت استرداد متهمان و مجرمان برای پاسخگویی به جرایم خویش، شاهد وجود اختلاف نظر و تفسیرهای گوناگون در مورد موضوع و کارکرد «استرداد مجرمان » هستیم که همین امر باعث شده است دیپلماسی پلیسی در این زمینه از کارایی مورد نظر برخوردار نباشد. چرا که ارائه تفسیرهای مختلف از ماهیت این جرم در کشورهای مختلف، تاثیر عوامل سیاسی و یا نوع روابط کشورها در پهنه بین المللی؛ موجب گردیده تا اینترپل در عمل در تحقق دیپلماسی پلیسی با چالش های اساسی روب هرو شده و در نیل به اهداف خود ناکام بماند.

analysis of police diplomacy in interpol with an emphasis on the extradition of criminals

background and purpose:the extradition of criminals is considered as a part of criminal justice in legal systems, and its purpose is to execute justice for criminals who have escaped from the crime scene. the importance of this is that by using this method of diplomacy in international relations, the opportunity arises for governments, institutions, and people whose rights have been violated to get their rights in a fair way. at the same time, those who have committed crimes should be held accountable for their actions. based on this, in this article, we intend to investigate police diplomacy in the process of extradition of criminals in international relations, and while evaluating the role of police diplomacy in the extradition of criminals, we will evaluate the influencing factors in this process and identify the existing challenges.method:according to the nature and topic of the research, the analytical-descriptive study method has been used to compile this work, and an attempt has been made to analyze the topic in the framework of qualitative methodology.findings and results:the extradition of criminals is considered as a method to establish legal order in international relations and prevent chaos caused by crime and the escape of criminals. this issue has caused legal mechanisms to be foreseen in international relations to execute justice on criminals and restore order to different societies, in which the police institution is at the center. despite accepting the need to extradite criminals to answer for their crimes, we witness the existence of differences and different interpretations regarding the issue and function of the issue of extraditing criminals, which has made police diplomacy ineffective in this field.
