مفهومی دیرین در بستری نوین: اعمال حقوق بی طرفی بر عملیات سایبری در آینه دستورالعمل تالین 2

زمینه و هدف: حقوق بی‌طرفی، شاخه‌ای از حقوق مخاصمات مسلحانه است که دوشادوش محدودیت و ممنوعیت توسل به زور، پدیدار گردیده است. از سوی دیگر، فناوری‌های نوین از جمله در قالب عملیات‌های سایبری، رنگ‌وبویی تازه به بیشینه حوزه‌های حقوق بین‌الملل و از جمله حقوق مخاصمات مسلحانه بخشیده‌اند. نگارندگان نوشتار فرارو سر آن دارند تا اعمال حقوق بی‌طرفی بر عملیات‌های سایبری را در آینه دستورالعمل تالین 2 راجع به حقوق بین‌الملل قابل اِعمال بر عملیات‌های سایبری (2017) وابکاوند.روش تحقیق: نوشتار حاضر از رهگذرِ کاربست شیوه توصیفی تحلیلی در تبیین مطالب و با تکیه بر منابع کتابخانه‌ای شامل کتاب‌ها و مقالات معتبر و مرتبط انگلیسی و فارسی در زمینه موضوع مطالعه، به رشته تحریر در آمده است.یافته‌ها و نتیجه‌گیری: بر اساس یافته‌های مقاله، تدوین‌کنندگان دستورالعمل تالین 2 بر این باورند که نظام سنتی بی‌طرفی را می‌توان بر عملیات‌های سایبری قابل اعمال دانست. به باور ما، اگرچه این گزاره روی‌هم‌رفته درست و منطقی است، ولی به نظر می‌رسد نمی‌توان تفاوت‌های چشمگیر عملیات‌های سایبری و به‌ویژه سلاح های سایبری را با سلاح‌های پیشین از نظر دور داشت. از این‌رو، بر این باوریم که در کنار نظام سنتی حاکم بر بی‌طرفی، نیازمند هنجارها و موازین نو و روزآمدی برای نظم‌بخشی به عملیات‌های سایبری در سپهر حقوق بین الملل هستیم

a traditional concept in a modern platform: application of law of neutrality on cyber operations in the mirror of tallinn manual 2.0

background and aim: law of neutrality is a branch of law of armed conflict (lac) which is appeared along with the limitation and prohibition of use of force. on the other side, new technologies, inter alia, through cyber operations has made a new wind to be blowing in the most areas of international law including lac. the authors of the present article seek to explore the application of law of neutrality on cyber operations in the light of 2017 tallinn manual 2.0 on international law applicable to cyber operations. research method: this article has been written through employing the descriptive analytical method in exploring the material and relying on library sources including the valid and related english and persian books and articles. findings and results: according to the findings of the article, the authors of tallinn manual 2.0 maintain that the traditional system of neutrality can be applied to cyber operations. we believe that although this is generally correct and reasonable, it appears that one cannot neglect the notable differences existing between cyber operations and specifically cyber weapons with previous weapons. consequently, we are of this opinion that besides the traditional system of neutrality, new and updated norms and standards are needed for regulating cyber operations in international law sphere.
