جعل های پیچیده ی رایانه ای (دیپ فیک)در بستر تعهدات حقوق بشری دولت ها

زمینه و هدف: همانند هر پدیدۀ دیگری جعل های پیچیده ی رایانه ای نیز به اَشکال مختلفی با شماری از حقوق و آزادی های بشری ارتباط پیدا می کنند. جعل های پیچیده ی رایانه ای در عین حال که یک شکل از بیان محسوب می شوند، دارای یک محتوا نیز هستند و این محتوا نیز می تواند با جنبه های دیگری از حقوق و آزادی های بشری ارتباط داشته باشد. سازمان جهانی مالکیت فکری بیان داشته است که دیپ فیک ها می توانند منجر به مشکلاتی جدی از قبیل نقض حقوق بشر، حق حریم خصوصی، حق حمایت از داده های شخصی و غیره شوند.روش: این تحقیق از نوع کاربردی و روش انجام تحقیق توصیفی- تحلیلی است و جمع آوری اطلاعات در آن از طریق بررسی اسنادی و فیش برداری بوده است.یافته ها و نتایج: یافته های تحقیق نشان می دهد با توجه به اینکه در سیاست جنایی دولت ها یکی از مولّفه هایی که باید مدنظر قرار گیرد، حقوق بشر است و از سوی دیگری دیپ فیک ها نیز با حقوق بشر ارتباط دارد، بنابراین یکی از چالش های پیش روی دولت ها هماهنگ سازی سیاست جنایی خود نسبت به دیپ فیک ها با در نظر داشتن ملاحظات حقوقی بشری است که موظّفند در سیاست جنایی خود، به عنوان بخشی از سیاست عمومی دولت، اتّخاذ نمایند.
