پیشگیری غیرکیفری از قتل های ناموسی با تاکید بر اقدامات پلیسی و رویکردهای بین المللی

زمینه و هدف: ناموس پرستی، ناموس خواهی و یا تعصب و غیرت نسبت به ناموس، نگاهی برآمده از فرهنگ مردسالاری است. در این فرهنگ زن به عنوان ناموس و از جمله متعلقات و دارایی های مرد محسوب می شود و باید مطیع و فرمانبر او باشد. زن باید به عنوان ناموس مرد، در درجه نخست نسبت به پدر و برادران و در مرتبه ای دیگر نسبت به شوهر و خانواده شوهر پاسخ گو باشد؛ یعنی، باید به طور کامل خواست و ارادۀ آن ها را در این زمینه ملاک قرار دهد و تمایل خویش را به فراموشی سپارد. همین رویکرد زمینۀ تعارض درون خانواده ها را فراهم می‌سازد و چنین تعارضی در مواردی به ارتکاب قتل زن می انجامد. در ادبیات عمومی، چنین قتل هایی به عنوان «قتل های ناموسی» به شمار می آیند.روش: پژوهش حاضر به روش توصیفی – تحلیلی انجام شده است.یافته ها و نتایج: در مسیر کنترل قتل های ناموسی در ایران به ویژه استان خوزستان با توجه به پیشینه عمیق فرهنگی و سنتی حاکم بر اقوام و گروه‌های اجتماعی این استان چالش‌های جدی در زمینه عصبیت و ساختارهای قبیله‌ای و تفکر مردسالارانه وجود دارد. از این رو اولویت در جهت مبارزه و کنترل قتل های ناموسی، تقویت و ایجاد زیرساخت های آموزشی و اقدمات آموزشی به پلیس و ضابطین قضایی و تقویت فرهنگ و الگوی رفتاری در کنار تقویت و پیشبرد اقدامات پلیسی باشد. اهمیت قتل های ناموسی تا بدان حد است که در پاره ای از قطعنامه مجمع عمومی سازمان ملل، این نوع از قتل ها در ردیف خشونت علیه زنان به شمار آمده و از دولت ها خواسته شده است تا برای پیشگیری، تعقیب و مجازات مجرمان اقدامات موثرتری را اعمال نمایند. از جمله بر اقدامات پیشگیرانۀ پلیسی تاکید شده است.

non-criminal prevention of honor killings with emphasis on police actions and international approaches

context and purpose: honor worship, honor seeking, or prejudice and zeal towards honor, is a view emerging from patriarchal culture. in this culture, a woman is considered as an honor and among the belongings and possessions of a man, and she must be obedient and submissive to him. as a man’s honor, a woman must be accountable to her father and brothers in the first place and secondly to her husband and his family; that is, he should completely consider their desire and will in this field and leave his desire to forget. this approach provides the basis for conflict within families, and such conflict sometimes leads to the murder of women. in general literature, such murders are considered as honor killings.method: the present research was carried out using a descriptive-analytical method.findings and results: in the way of controlling honor killings in iran, especially in khuzestan province, due to the deep cultural and traditional background governing the tribes and social groups of this province, there are serious challenges in the field of nervousness, tribal structures and patriarchal thinking. there is. therefore, the priority should be to fight and control honor killings, strengthen and create educational infrastructure and training measures for police and judicial officers, and strengthen culture and behavior pattern along with strengthening and advancing police measures. the importance of honor killings is so much that in some of the resolutions of the united nations general assembly, this type of killings is included in the ranks of violence against women, and governments are asked to take more effective measures to prevent, prosecute and punish criminals. apply among other things, preventive police measures have been emphasized.
