رهیافت های حقوق بین الملل برای توازن قدرت در نظم جهان کنونی

زمینه و هدف: امروزه با دگردیسی قدرت در نظم نوین جهانی، سرشت تهدیدات بین المللی نیز دچار دگرگونی شده است. این دگردیسی، توجه به جایگاه ویژه حقوق بین الملل در پاسداشت صلح و امنیت بین المللی و نیز ضرورت بازنگری در قواعد حقوقی بین المللی را بیش از پیش ضروری نموده است. بر این اساس، پژوهش حاضر در تلاش برای پاسخ به این پرسش است که؛ حقوق بین الملل با چه رهیافت هایی و چگونه می تواند در نظم نوین جهانی، نقش واقعی خود در توازن قدرت را بجای آورد.روش تحقیق: روش تحقیق در این پژوهش، توصیفی – تحلیلی است که با خوانش کتاب ها، پژوهش های معتبر و کاوش در اسناد حقوقی و رویه های بین المللی انجام شده است.یافته ها: یافته‌های پژوهش بیانگر آن است؛ جهان کنونی با پیدایش قدرت‌های گوناگون جهانی و منطقه ای در مرحله نوینی قرار گرفته که یکی از الزامات مهم آن توازن قدرت در پهنه های مختلف به ویژه در ارتباط با حقوق بین الملل می باشد. اما از آن جا که حقوق بین الملل، همگام با دگردیسی های پدید آمده در نظام بین الملل، روزآمد نگشته و همچنان با قواعد سنتی خود فعالیت می کند؛ برای دست یابی به جایگاه شایسته خود، باید در پرتو رهیافت هایی مانند «پشتیبانی بین المللی از رویه های نوین»، «پیش بینی ضمانت اجراهای بایسته بین المللی»، «بازنگری مقررات بین المللی نسبت به کاربست قدرت هوشمند» و «توسعه حقوق داخلی و ارتقاء مشارکت جهانی» در ساختار و کارکرد ِخود بازنگری نماید.

background and purpose: with the change in the nature of power in the new world order, the nature of international threats has also changed. this transformation has made it more necessary to pay attention to the special position of international law in maintaining international peace and security, as well as the need to review international legal rules. based on this, the present research seeks to answer the question that in the new world order, with what approaches and how can international law play its real role in the balance of power.research method: the research method in this research is descriptive analytical, which was done by studying books, authoritative articles, and examining legal documents and international procedures.findings: the findings of the research show that; the current world has entered a new stage with the emergence of many regional and global powers, one of the important requirements of which is the balance of power at different levels, especially in relation to international law. but since international law has not been updated along with the changes that have occurred in the international system; in order to achieve its rightful position in the desired balance of power, it is necessary in the light of approaches such as international support for innovative procedures, anticipation of the guarantee of adequate international executions, revision of international regulations regarding the use of intelligent power and the development of domestic rights and the level of global participation, to accept reforms in its structure and function.
