تاملی بر تحولات حقوقی شناسایی جنایات بین المللی محیط زیستی در برخی وقایع و رویه‌های بین المللی از منظر حقوق مخاصمات مسلحانه

زمینه و هدف: محیط زیست یکی از قربانیان خاموش جنگ است.آثار، شیوه‌ها و ابزار بکار گرفته شده در مخاصمات مسلحانه تا سال‌ها بر محیط زیست مناطق درگیری و حتی سرزمین‌های همجوار باقی می‌ماند. جرم انگاری اقداماتی که توسط اشخاص و دولت‌ها منجر به تخریب شدید و گسترده و طولانی مدت محیط زیست می‌شود از دهه نود قرن بیستم در ادبیات حقوق بین الملل مورد توجه قرار گرفته است.روش: روش مطالعه این مقاله توصیفی- تحلیلی با استفاده از منابع معتبر، اسناد و رویه‌های قضایی بین المللی است.یافته‌ها و نتیجه گیری: در این مقاله سعی شده است تحولات و چارچوب حقوقی شناسایی جنایات بین المللی از منظر محیط زیست در برخی رویه‌های بین المللی مورد بررسی و ارزیابی قرار گیرد. پرسش اساسی این است که جنایات بین المللی محیط زیستی چگونه در برخی وقایع و رویه بین المللی مورد توجه قرار گرفته و تاکنون توسعه یافته است. فرض اساسی این مقاله در پاسخ به این پرسش بر این مبنا استوار است که جنایات محیط زیستی نه یک جرم مستقل بلکه رکن مادی ارتکاب جنایات بین المللی در ادبیات حقوق کیفری بین المللی مطرح و توسعه یافته است.

a reflection on legal developments in the identification of international environmental crimes in some international events and procedures from the perspective of armed conflict law

background and aim: the environment is one of the silent victims of war. the effects, methods and tools used in armed conflict remain on the environment of conflict areas and even neighboring lands for many years. the criminalization of actions by individuals and state that lead to severe, widespread, and long-term environmental degradation has been considered in the international law literature since the 1990s.method: the method of study of this article is analytical and descriptive using reliable sources, documents and international judicial procedures.findings and conclusion: in this article, we have tried to study and evaluate the developments and the legal framework for identifying international crimes from an environmental perspective in some international procedures. the fundamental question is how international environmental crimes have been addressed and developed in some international events and practices. the basic premise of this article in response to this question is based on the environmental crime is not an independent crime but a material element of international crime in the international criminal law literature.
