ماهیت تروریستی اقدامات داعش و مسئولیت دولت‌ها در حوزه حقوق کیفری بین‌الملل

زمینه و هدف: تروریست‌ها برای رسیدن به مقاصد خود نیازمند حمایت مالی هستند و بایستی به طریقی منابع مالی خود را تامین نمایند. از زمان شروع درگیری‌ها در سوریه از سال 2011 کشورهای غربی و عربی به حمایت از شورشیان سوریه اقدام کردند که اوج این حمایت در شناسایی ائتلاف مخالفان سوریه از سوی 130 کشور بود. با ظهور داعش فصل جدیدی آغاز شد که به‌احتمال می‌رفت که کشورهای غربی و عربی به دلیل فعالیت تروریستی از آن‌ها حمایت نکنند، هرچند ائتلاف بین‌المللی ضد داعش شکل گرفت اما شواهد بیانگر حمایت برخی گروه‌ها، دولت‌ها و کشورها از این جریان تکفیری بود.روش: این مقاله را به روش توصیفی - تحلیلی انجام‌شده است.یافته‌ها و نتایج: یکی از راه‌های مبارزه با پدیده‌ی تروریسم، مبارزه با تامین مالی آن است؛ به این منظور کشورها خود به‌طور مستقیم یا از طریق سازمان ملل متحد مبادرت به تهیه اسناد و مقرراتی جهت مسدود نمودن راه‌های تامین مالی تروریسم نموده‌اند، از منظر اسناد بین‌المللی نیز تامین مالی تروریسم به معنای فراهم آوردن انواع منابع مالی و فنی همچنین هرگونه تسهیلات دائمی و موقتی برای تروریست‌ها از مصادیق بارز حمایت دولت‌ها از تروریسم است. بااین‌وجود یکی از ضوابط تبیین ماهیت کیفری تروریسم از منظر حقوق بین‌المللی، شناسایی میزان مسئولیت دولت‌ها و افراد در تامین مالی است.

field and aims: to achieve their goals, terrorists need financial support and must somehow secure their financial resources. since the beginning of the conflict in syria in 2011, the western and arab countries supported the syrian rebels, and the peak of this support was the recognition of the syrian opposition coalition by 130 countries. with the emergence of isis, a new chapter began, and it was likely that the western and arab countries would not support them due to their terrorist activities, although the international coalition against isis was formed, but the evidence showed that some groups, governments, and countries supported this takfiri trend.method: this article has been done in a descriptive-analytical way. finding and conclusion: from the point of view of international documents, terrorism financing means providing all kinds of financial and technical resources, as well as any permanent and temporary facilities for terrorists, which are clear examples of governments supporting terrorism. nevertheless, one of the criteria for explaining the criminal nature of terrorism from the perspective of international law is to identify the level of responsibility of states and individuals in financing.
