برداشت از حاکمیت قانون در رویه شورای امنیت با تاکید بر حقوق بشر

زمینه و هدف: ضرورت لزوم و بحث در مورد حاکمیت قانون در رویه شورای امنیت پس از دهه‌ها بی‌توجهی امروزه بیشتر توجه حقوقدانان را به خود جلب کرده است. توجه به حاکمیت قانون با تاکید حقوق بشری آن به مفهوم تحدید قدرت خودسرانه دولت‌ها به منظور حفظ حقوق و آزادی‌های بنیادین فردی و ابزاری جهت حفظ صلح و امنیت بین‌المللی برای اعتلای حقوق بشر است.روش: پژوهش حاضر با روش توصیفی- تحلیلی انجام ‌شده است.یافته‌ها و نتایج: بحث از حاکمیت قانون در شورای امنیت برداشت‌های مختلفی را در بر داشته است و همین امر موجب شده که هنوز در اکثر منابع از آن تعریفی به عمل نیاید؛ چون حاکمیت قانون و اجرای آن به ابزاری سیاسی در دست اعضای شورای امنیت و برای بهره‌گیری از منافع سیاسی خود مورد اعمال قرار می‌گیرد که این خود نشان‌دهنده‌ی غلبه‌ی سیاست عملی بر عرصه‌ی بین‌المللی و تقدم سیاست بر حقوق، در بسیاری از موارد قواعد بین‌المللی از سوی واضعان آن است.یافته‌ها و نتایج: بحث از حاکمیت قانون در شورای امنیت برداشت‌های مختلفی را در بر داشته است و همین امر موجب شده که هنوز در اکثر منابع از آن تعریفی به عمل نیاید؛ چون حاکمیت قانون و اجرای آن به ابزاری سیاسی در دست اعضای شورای امنیت و برای بهره‌گیری از منافع سیاسی خود مورد اعمال قرار می‌گیرد که این خود نشان‌دهنده‌ی غلبه‌ی سیاست عملی بر عرصه‌ی بین‌المللی و تقدم سیاست بر حقوق، در بسیاری از موارد قواعد بین‌المللی از سوی واضعان آن است.
