واکاوی ظرفیت‌های حقوقی کمیسیون نظارت بر پرونده‌های سازمان اینترپل

زمینه و هدف : اینترپل یک سازمان بین المللی است که هدف از تشکیل این سازمان، ایجاد یک سیستم بین المللی و مبارزه با جرم و مجرمین و همکاری و تبادل اطلاعات بین پلیس کشورهای مختلف دنیا می باشد. یکی از ارکان این سازمان کمیسیون نظارت بر پرونده ها می باشد که برای شناخت ظرفیت های آن لازم است تا ساختار، ترکیب، هدف ایجاد و همچنین اختیارات آن مورد بررسی قرار گیرد.روش: این مقاله به روش توصیفی- تحلیلی نگارش یافته است.یافته ها و نتایج: سازمان عبارت از مجمع عمومی، کمیتۀ اجرایی، دبیرخانۀ کل، دفاتر ملی مرکزی کشورها، مشاوران و کمیسیون کنترل (نظارت) بر پرونده ها است. در اساسنامه تشکیل کمیسیون نظارت بر پرونده ها صلاحیت های مختلفی برای این کمیسیون تعریف شده است. کمیسیون متشکل از دو اتاق است: «یک اتاق نظارت و مشورت و یک اتاق درخواست می باشد. اتاق های نظارت و مشورت و همچنین اتاق درخواست، مطابق اساسنامه این اختیار را دارند تا وظایف مندرج در این سند را که بر عهده کمیسیون است انجام دهند. این اختیارات نه صرفا محدود به مواردی است که در اساسنامه تصریح شده است بلکه تا جایی است که به اهداف ایجاد سازمان منتج شود. اختیارات کمیسیون نظارت بر پرونده ها نیز شامل دسترسی به داده ها و اطلاعات، بهره گیری از مشورت متخصصان، اختیارات اتاق نظارت و مشورت و اختیارات اتاق درخواست می باشد که در اساسنامه برای انها موارد متعددی پیش بینی شده است.

background and purpose: interpol is an international organization that aims to create an international system to fight crime and criminals and to cooperate and exchange information between the police of different countries in the world. one of the entities of this organization is “commission for the control of interpol’s files (ccf)”, in order to know its capacities, it is necessary to examine its structure, composition, purpose of creation, and also its powers.method: this article is written in a descriptive-analytical way.findings and results: the organization consists of the “general assembly”, “executive committee”, “general secretariat”, “central national bureuse (ncb)” of the countries, “advisers” and “commission for the control of interpol’s files (ccf)”. in the constitution of ccf, various authorities and powers are defined for this commission. the commission consists of two chambers: one is a monitoring and consultation chamber and one is a request chamber. the monitoring and consultation chambers as well as the request chamber, according to the statutes, have the authority to perform the duties listed in this document, which are the responsibility of the commission. these authorities are not only limited to the cases specified in the statute, but to the extent that they lead to the goals of the organization. the powers of ccf also include access to data and information, the use of experts’ advice, the powers of the monitoring and consultation room, and the powers of the request room, for which many things are foreseen in the statute.
