تحلیل مسئولیت مدنی سازمان ها و نیروی انتظامی در شیوع بیوتروریسم (با تاکید بر کوید 19)

زمینه و هدف: با شیوع ویروس کرونا در کشور و نمایان شدن شواهد بیوتروریسم، احتمال بیوتروریسمی بودن این ویروس قوت گرفت. پژوهش حاضر با هدف شناسایی مسئولیت انواع اشخاص حقوقی در قبل، حین و بعد از شیوع بیوتروریسم با تاکید بر کووید19 نگاشته شده است.روش تحقیق: پژوهش حاضر با روش توصیفی و تحلیلی و با استفاده از مطالعات کتابخانه ای و ابزار فیش برداری، متون مرتبط را مطالعه و ارزیابی نموده است.یافته ها و نتیجه گیری: سازمان ها و نیروی انتظامی در زمان قبل، حین و بعد از شیوع بیوتروریسم کرونا در زمینه پیش بینی، پیشگیری و درمان بیوتروریسم مسئولیت دارند. نوع این مسئولیت بر مبنای مسئولیت قهری است که در برخی موارد ممکن است قراردادی هم باشد. ارکان مسئولیت مدنی با ضرری که مسلم است و اعمال زیانبار این اشخاص که ناشی از نقض تکالیف ذاتی و مصوبات ستاد ملی کرونا می باشد، شکل می گیرد و احراز رابطه سببیت با توجه به نظریه تقصیر و خطر، انجام می شود. این سازمان ها و نیروی انتظامی، در صورت تعدد اسباب عرضی، بر مبنای نظریه نسبت تاثیر، مسئولیت داشته و در صورت تعدد اسباب طولی، بر مبنای سبب مقدم در تاثیر، مسئولیت خواهند داشت. سازمان ها و نیروی انتظامی، در زمینه پیش بینی، پیشگیری و درمان می توانند بر مبنای امر آمر قانونی، دفاع مشروع و قاعده اقدام، با لحاظ شرایطی از مسئولیت مدنی معاف شوند. وزارت خارجه، اطلاعات، سازمان پدافند غیرعامل، وزارت بهداشت، بسیج، شهرداری و صدا و سیما، از مصادیق سازمان های دولتی و عمومی هستند که بنابر شرح وظایف و مصوبات ستاد ملی مقابله با بیماری کرونا، در قبال پیش بینی، پیشگیری و درمان بیوتروریسم کووید 19 مسئولیت دارند.
