رویارویی با جرائم سازمان یافته ملی و فراملی از تئوری تا عمل

زمینه و هدف: با وجود چندین دهه از مطرح شدن مفهوم جرایم سازمان یافته، هنوز هیچ سند بین‌المللی-منطقه‌ای به تعریف مشخص و کاملی از این جرایم نرسیده است. این نوع از بزهکاری با تنوع مظاهر، پیچیدگی در شیوه‌های ارتکاب و گسترش روز افزون، پیامدها و آثار زیانباری از جنبه‌های سیاسی، امنیتی، اقتصادی و فرهنگی به کشورها و جوامع تحمیل و چالش های جدی را در سطوح ملی و بین المللی ایجاد کرده است. ماهیت خاص و فراغت از زمان و مکان در ارتکاب جرایم سازمان یافته؛ و ابعاد مختلف این پدیده، مبارزه و مقابله ی موثر با آن را با چالش هایی مواجه نموده است. در این پژوهش، سعی شده با بررسی نظام‌مند‌ ‌و‌ تاریخی مفاهیم جرائم‌سازمان‌یافته، به شناسایی مفهومی خاص از این جرایم و طرح‌ریزی راهبردهای مناسب در رویارویی با آنها پرداخته شود. روش شناسی: پژوهش حاضر بر اساس روش توصیفی-تحلیلی و بر پایه ی اسناد و منبع کتابخانه ای نگاشته شده است و در این راستا با مطالعه ی اسناد بین المللی و قوانین داخلی، با هدف کاربردی، اطلاعات بدست آمده مورد تجزیه و تحلیل قرار گرفته است.نتایج و یافته ها: نتایج تحقیق نشان می‌دهد پس از شناسایی و درک مفهوم جرایم سازمان یافته -که لازمه ی مواجهه با هر پدیده ی نوظهوری می باشد- برای جلوگیری از بیراهه رفتن در رویارویی با جرایم سازمان یافته، باید ضمن توجه به ابعاد این پدیده شامل «سازماندهی فعالیت های غیرقانونی»، «سازماندهی ساختارهای تبهکاری» و «سازماندهی گستره اجتماعی(حکمرانی غیرقانونی)»؛ به تناسب هر یک از این سویه‌ها، اقدامات پیشگیرانه و سرکوبگرانه طرح ریزی شود.

dealing with national and transnational organized crime from theory to practice

background and aim: despite the decades of introduction of the concept of organized crime, no international-regional document has yet reached a clear and complete definition of these crimes. this type of crime with a variety of manifestations, complexity in the methods of perpetration and increasing expansion, consequences and harmful effects from political, security, economic and cultural aspects to countries and societies impose serious challenges at the national and international levels. created. the special nature and leisure of time and place in committing organized crime; and the various dimensions of this phenomenon, the effective struggle and confrontation with it has faced challenges. in this study, an attempt has been made to systematically and historically examine the concepts of organized crime, to identify a specific concept of these crimes and to plan appropriate strategies to deal with them.methodology: the present study is based on a descriptive-analytical method and based on documents and library sources, and in this regard, by studying international documents and domestic laws, with a practical purpose, the obtained information is analyzed. is.results and findings: the results of the research show that after identifying and understanding the concept of organized crime - which is necessary to deal with any emerging phenomenon - to avoid going astray in the face of organized crime, we must pay attention to the dimensions this phenomenon includes organizing illegal activities, organizing criminal structures and organizing the social sphere (illegal governance); preventive and repressive measures should be planned in accordance with each of these aspects.
