تحول در ماهیت مسئولیت مدنی ناشی از حوادث رانندگی در نظام حقوقی ایران با نگاهی به نقش پلیس راهنمایی و رانندگی

مسئولیت مدنی تعهد قانونی شخص بر رفع ضرری که به دیگری وارد کرده است خواه این ضرر ناشی از تقصیر خود وی باشد یا ناشی از فعالیت او شده باشد. بر این مبنا در هر موردی که شخص ناگزیر از جبران خسارت دیگری باشد، در برابر او مسئولیت مدنی دارد. با توجه به استفاده روزافزون از تومبیل شاهد بروز حوادث رانندگی و ورود خسارت از این منظر هستیم. مبنا و ارکان مسئولیت مدنی در تصادفات چیست؟ و پلیس راهنمایی و رانندگی در این خصوص از چه جایگاهی برخوردار است؟روش تحقیق: این مقاله به شیوه تحلیلی- توصیفی نگارش یافته است.یافته ها: در نظام حقوقی ایران مبانی متعددی موجب شکل گیری مسئولیت مدنی می گردد که از آن جمله می توان به تقصیر ، خطر و تضمین حق اشاره نمود. همچنین در بررسی ابعاد حقوقی مسئولیت مدنی ناشی از حوادث رانندگی در قانون ایران ارکان شکل گیری این مسئولیت که شامل وجود خسارت، وقوع تصادف و رابطه سببیت اشاره نمود. در خصوص تحولات در قانون مسئولیت مدنی ناشی از حوادث رانندگی باید به دو مورد در قانون بیمه اشاره نمود یکی تعهد به بیمه یا تعهد به جبران خسارت در قانون جدید و دیگر مبناء مسولیت دارنده وسیله نقلیه .نتایج: در تجولات مسئولیت مدنی نقش پلیس راهنمایی و رانندگی از دو جنبه دارای اهمیت است. نخست هنگامی که پلیس به عنوان کارشناس در صحنه تصادفات حاضر می گردد، دوم نقش پلیس در مدیریت صحنه تصادف از می تواند بروز آسیبهای دیگر پیشگیری به عمل می آورد.
