مطالعه تطبیقی بررسی صلاحیت هیات نظارت و شورای عالی ثبت در نظام حقوق ایران و انگلستان

زمینه و هدف: با توجه به اهمیت ثبت املاک در تنظیم امنیت اجتماعی و بستر سازی آن برای تثبیت معاملات و قدیمی بودن قوانین ثبتی ایران در مقایسه با کشور هائی همانند انگلستان که از نظر سیستم ثبتی پیشگام هستند، مطالعه و مقایسه سیستم ثبتی انگلستان می تواند در ارائه راه‌حل ها و بهبود سیستم عملکرد و رفع خلاهای قانونی در کشور ما موثر باشد. بدین منظور و با توجه به اهمیت پژوهش، هدف پژوهش حاضر مطالعه تطبیفی بررسی صلاحیت هیات نظارت و شورای عالی ثبت در نظام حقوق ثبت ایران با کشور انگلستان می باشد. روش شناسی: در این تحقیق روش کتابخانه ای مورد عمل قرار گرفته است و به قوانین، آیین نامه ها، قوانین خاص، بخش نامه های ثبتی و کتب، مقالات، پایان نامه های ثبتی در هر دو کشور رجوع شده است.یافته ها: هیات نظارت در ایران از دو قاضی و مدیر کل ثبت استان یا قایم مقام او که معاون یا کفیل ثبت منطقه است تشکیل می شود. و در شورای عالی ثبت صلاحیت رسیدگی به اشتباهات و اختلافات ثبتی و اظهار نظر در خصوص آنها را دارد. نتیجه گیری: تشکیلات سازمانی مشابه با سازمان ثبت اسناد و املاک ایران در کشور انگلستان، اداره ثبت املاک و مستغلات می باشد، شمای کلی امور ثبت و متولی آنها در کشور انگلستان نشان می دهد که مشابه ایران سازمان فوق به نظارت ثبت اسناد، املاک و مالکیت معنوی می پردازد.

considering the importance of property registration in regulating social security and creating a platform for stabilizing transactions and the obsolescence of iranian registration laws compared to countries such as the united kingdom that are pioneers in terms of registration system, study and compare the uk registration system can to be effective in providing solutions and improving the performance system and eliminating legal gaps in our country. for this purpose and considering the importance of the research, the purpose of the present study is a comparative study to examine the competence of the supervisory board and the high council of registration in the system of registration law of iran with the united kingdom.methodology: in this research, the library method has been used and reference has been made to laws, regulations, special rules, registration letters and books, articles, registration dissertations in both countries.the supervisory board in iran consists of two judges and the director general of the provincial registry or his deputy who is the deputy or guardian of the regional registry. and in the high council of registration has the authority to deal with errors and registration disputes and to comment on them.conclusion: the organizational structure similar to the iranian real estate registration organization in the united kingdom is the real estate registration office. the general outline of their registration and custodian affairs in the united kingdom shows that similar to iran, the above organization supervises the registration of real estate, real estate and pays intellectual property.
