جهانی شدن جرم و ضرورت سیاست گذاری جدید پلیس در مبارزه با جرایم فراملی

زمینه و هدف: نظریه جهانی شدن حقوق کیفری در سطح جهانی و بالتبع ایران نظریه جدیدی است که چالش های آن مورد بررسی قرار نگرفته است. از طرفی مطالعه ماهیت و جنبه های جرم شناختی جرایم جهانی نیاز به جهانی فکر کردن پلیس و رویکرد تحقیقاتیِ فراملی دارد، چنان که پلیس کشورهای مختلف، نیاز به کسب اطلاعات و آمار جنایی جوامع یکدیگر و همکاری در این زمینه دارند. لذا بایستی یافته های جرم شناسی به کمک عدالت کیفری بین المللی برای مقابله آگاهانه با جرایم جهانی یعنی تعریف راهبرد مبتنی بر مطالعات جرم شناختی مرتکبان و بزه دیدگان جرایم فراملی بشتابد. این پژوهش با هدف، سیاست گذاری جدید پلیس در زمینه مبارزه با جرایم فراملی انجام شده است. روش شناسی: باتوجّه به ماهیّت موضوع، پژوهش حاضر از نظرگردآوری اطلاعات به روش اسنادی و از طریق مطالعه قوانین داخل، اسناد بین المللی و منابع معتبر انجام شده و اطلاعات به دست آمده به صورت توصیفی- تحلیلی مورد تجزیه وتحلیل قرار گرفته است.یافته های پژوهش: با توجه به جهانی شدن جرایم و چالش های آینده، معماری انسانی، ساختار سازمانی، برنامه ریزی، سیاست گذاری و فرهنگ حاکم بر سازمان پلیس باید به گونه ای طراحی و اجرا شوند که کارکنان پلیس را به طور مستمر به سوی کاربرد عملی مبارزه با جرایم فراملی هدایت کند.نتیجه گیری: آنچه می تواند از تهدیدهای ناشی از جرایم جهانی بکاهد، تدوین سیاست های پلیسی مناسب، تقویت ابزارهای مبارزه با این گونه جرایم، انعقاد قرارداد منطقه ای و بین المللی جهت همکاری های پلیسی است.

globalization of crime and the need for new policy making by police in the fight against transnational crimes

background and aim: the theory of globalization of criminal law in the world and consequently in iran is a new theory whose challenges have not been studied. on the other hand, the study of the nature and criminological aspects of global crimes requires global thinking being run by police and transnational investigative approach, as the police of different countries need to obtain information and criminal statistics from each other’s communities and cooperate in this field. therefore, criminological findings should be accelerated with the help of international criminal justice to consciously deal with global crimes, i.e. the definition of a strategy based on the criminological studies of perpetrators and victims of transnational crimes.  this study has been done with the purpose new policy making by police in the fight against transnational crimes. methodology: due to the nature of the subject, the present study has been done in terms of collecting information based upon the documentary method and by studying domestic laws, international documents and validated sources and the obtained information has been analyzed descriptively-analytically. findings: due to the globalization of crimes and future challenges, staff architecture, organizational structure, planning, policy-making and culture of the police organization should be designed and implemented in a way that guide police officers constantly to the applied practice of the fight against transnational crime.
