زمینه‌های دخالت نیروهای مسلح در نظام انتخاباتی آمریکا (مورد مطالعه؛ دستورالعمل 1344.10 وزارت دفاع آمریکا)

زمینه و هدف: مسئله دخالت نیروهای مسلح در انتخابات بخاطر وابستگی این ارگان ها به حاکمیت و دولت، همواره مورد انتقاد مردم و کاندیداها بوده و با توجه به سازمانی بودن نیروهای مسلح، در همه جای دنیا اصل بر بی طرفی آنها در انتخابات می باشد. چراکه در قانون اساسی هر کشوری، وظایف و تکالیف نیروهای مسلح برای حراست از تمامیت ارضی تعریف گردیده و امور سیاسی به مردم غیر نظامی واگذار شده است. در این مقاله قصد دارم نظام دموکراسی ایالات متحده آمریکا در خصوص دخالت نظامیان در انتخابات و فعالیت های سیاسی را بررسی نمائیم.روش: این مقاله‌ی پژوهشی از حیث هدف، کاربردی و توسعه‌ای بوده که داده‌ها با روش کتابخانه‌ای جمع‌آوری و به روش کیفی تجزیه و تحلیل شده است.یافته‌ها و نتایج:ایالات متحده آمریکا یکی از کشورهایی است که انتخابات زیادی در آن برگزار میشود، هرچند که انتخابات ریاست جمهوری آن تلفیقی از انتخابات مستقیم و غیر مستقیم است، اما رئیس جمهور از طریق انتخابات سراسری انتخاب و فرماندهی نیروهای مسلح را نیز بر عهده دارد. با بررسی دستورالعمل 1344.10 وزارت دفاع آمریکا به این نتیجه دست یافتیم که نظام حقوقی آمریکا نیز دخالت نیروهای مسلح در انتخابات و فعالیت های سیاسی را برای دموکراسی مضر می داند. ولی با این حال در انتخابات ریاست جمهوری 2020 دونالد ترامپ برای بقا در قدرت قصد استفاده از ارتش و سرکوبی دموکراسی را داشت که با اعتراضات گسترده این هدف به ناکامی کشیده شد.

field and aims: the issue of the intervention of the armed forces in the elections has always been criticized by the people and candidates due to the dependence of these institutions on the government and due to the organizational nature of the armed forces, their neutrality in the elections. all over the world, elections must be held impartially. because in the constitution of each country, the duties and responsibilities of the armed forces are defined to maintain territorial integrity, and political affairs are left to the civilian population. in this article, i intend to examine the democratic system of the united states of america regarding the involvement of the military in elections and political activities.methodology: this paper is a research in terms of purpose, application and development that the data were collected by library method and analyzed qualitatively.findings and conclusion: the united states of america is one of the countries where many elections are held, although its presidential election is a combination of direct and indirect elections, but the president is also in charge of choosing and commanding the armed forces through national elections. by examining the directive 1344.10 of the us ministry of defense, we came to the conclusion that the us legal system considers the involvement of the armed forces in elections and political activities as harmful to democracy. however, in the 2020 presidential election, donald trump intended to use the army and suppress democracy in order to stay in power, which was thwarted by widespread protests.
