کاستیها، چالشها و راهکارهای کشف جرائم سایبری با تاکید بر همکاریهای بین المللی پلیس

زمینه و هدف: در عصر حاضر فضای سایبری نقش ویژه خود را یافته و توجه جهانیان را به شدت به خود جلب کرده است. با توجه به ویژگی‌های نظیر پویایی و تغییرپذیر بودن فضای سایبری؛ نهاد کشف جرم در نظام حقوقی ایران با خلاءهای و چالش‌هایی همراه است.روش تحقیق: مقاله حاضر که به شیوه توصیفی تحلیلی و با روش کتابخانه‌ای اسنادی به نگارش درآمده است.یافته‌ها: نهاد کشف جرم در ایران، با خلاءها و چالش‌های متعددی در کشف جرایم سایبری مواجه است که از مهمترین مصادیق آن عبارتند از: نگرش ناهمسو به پلیس فتا بر پایه دادرسی افتراقی، نبود تکلیف قانونی برای آموزش تخصصی به پلیس‌های تخصصی، نبود اختیارات ویژه برای پلیس در مواجهه با جرائم سایبری، ضعف در تعامل و همکاری موثر با پلیس در کشف جرایم سایبری، ایجاد انگیزه مادی در قانون برای جذب در پلیس‌های تخصصی نظیر پلیس فتا. نتیجه‌گیری: در کنار این خلاءها، نهاد کشف جرم با چالش‌هایی نیز مواجه می‌باشند که؛ پنهان‌سازی جرم سایبری، عدم محدودیت قلمرویی و جنبه بین‌المللی داشتن، اخفای مجرمین، کدگذاری و امحای مدارک، شکاف در تجهیزات فناورانه، عدم تخصص کافی مراجع قضایی و انتظامی، در اولویت قرار ندادن جرایم سایبری و فقدان سیاست جنایی منسجم، مهمترین مصادیق چالش‌هایی هستند که جهت کشف جرایم سایبری پیش‌روی نهاد کشف قرار دارند.

background and purpose: in today’s era, the cyber space has found its special role and has attracted the attention of the world. considering the characteristics such as the dynamic and changeable nature of the cyberspace; the institution of crime detection in iran’s legal system is associated with gaps and challenges.research method: this article is written in a descriptive, analytical and documentary library method.findings: the crime detection agency in iran is faced with many gaps and challenges in detecting cyber crimes, the most important examples of which are: unequal attitude towards fata police based on differential proceedings, lack of legal obligation for specialized training for specialized police officers, lack of special powers for the police in the face of cybercrimes, the lack of effective interaction and cooperation with the police in the detection of cybercrimes, creating a material incentive in the law to attract specialized police such as the fata police.conclusion: in addition to these gaps, the crime detection institution also faces challenges that; concealment of cybercrime, lack of territorial limitation and international aspect, concealment of criminals, coding and erasure of documents, gap in technological equipment, lack of sufficient expertise of judicial and law enforcement authorities, not prioritizing cybercrime and lack of coherent criminal policy are the most important examples of challenges that in order to detect cyber crimes, they are in front of the kashf institution.
