بررسی وضعیت حقوقی جنگجویان خارجی از منظر حقوق بشردوستانه

زمینه و هدف: این مقاله بر جنبه های حقوقی مساله جنگجویان خارجی از دید گاه حقوق بشری و چالش های به وجود آمده‌از این پدیده و نگرانی ها ی موجود و دسته بندی های منبعث از این موضوع بین دول و در عرصه روابط بین الملل تاکید خواهد نمود و هدف اصلی که به‌ان اهتمام شده‌است تشریح مقررات و قوانین بشر دوستانه بین المللی در این خصوص و در راستای تفهیم و تبیین اقدامات جنگجویان خارجی و تعدیل و تخفیف و مدیریت و کنترل مضار و عواقب ناخوشایند این پدیده در حد مطلوب و با آنالیزکردن چالش های به وجود آمده می باشد.روش شناسی: پژوهش حاضر با روش توصیفی و تحلیلی انجام شده‌است.یافته ها و نتایج: در تحقیق حاضر با بررسی پدیده جنگجویان خارجی که هم اینک با از میان رفتن مرزهای بین المللی توسط گزاره هایی چون ایدئولوژی و منافع شخصی، یکی از مهمترین دغدغه های کشورهای دنیا شده‌است، به منابع حقوقی علیه‌این واقعیت به‌انضمام منابع و قلمرو حقوق بشردوستانه ناظر بر پدیده جنگجویان خارجی پرداخته شده‌است. در پایان حدود انطباق قوانین و مقررات بین المللی موجود ناظر بر مقوله جنگجویان خارجی، با حقوق بشر دوستانه بررسی و مطالعه گردید که نتیجه گرفته شد قوانین و مقررات بین المللی موجود در رابطه با مقوله جنگجویان خارجی با حقوق بشردوستانه تا حدود زیادی منطبق است.
