تحلیل حقوق شهروندی در قانون اساسی جمهوری اسلامی ایران با تاکید بر اسناد بین المللی

زمینه و هدف: حقوق شهروندی، مجموعه امتیازات و برخورداری‌هایی است که در نظام حقوقی یک کشور به شهروندان آن، با لحاظ نمودن دو اصل کرامت انسانی و منع تبعیض در جهت فراهم ساختن زمینه رشد شخصیت فردی و اجتماعی به آنها اعطا می‌شود، امری که امروز به عنوان یک حق بنیادین حتی در اسناد بین‌المللی هم به آن اشاره شده است. لازمه رعایت این حق، شناسایی و لزوم احترام به این حق در قانون اساسی است. لذا، در این تحقیق، به تبیین حقوق شهروندی در قانون اساسی جمهوری اسلامی ایران با تاکید بر اسناد بین‌المللی می‌پردازیم.روش‌شناسی: روش تحقیق در این مقاله، توصیفی تحلیلی است که با مطالعه کتب و مقالات معبر صورت گرفته است. یافته‌ها و نتیجه‌گیری: قانون اساسی جمهوری اسلامی ایران با تاکید بر اصل تفکیک قوا و استقلال عملکردی نهادهای قدرت و تاکید بر اصول برابری، عدالت، امنیت، حاکمیت خداوند و تامین حقوق همه‌جانبه مردم، پایه‌گذار ابتدایی حقوق شهروندی می‌باشد که زمینه‌ساز تقنین قواعد فردی و گروهی در جنبه‌های اقتصادی، اجتماعی، سیاسی و فرهنگی گردید. تبیین و شناسایی حقوق اجتماعی، اقتصادی، سیاسی در قانون اساسی به عنوان حقوق مردم خود یکی از الزامات حق‌های موجود در اسناد بین‌المللی می‌باشد، فلذا مشروعیت بخشیدن به حقوق شهروندی در قانون اساسی جمهوری اسلامی ایران زمینه‌ساز لزوم احترام به این حق در سایر مقررات موضوعه می‌باشد.

background and aim: citizenship rights are a set of privileges and enjoyments that are granted to its citizens in the legal system of a country, by considering the two principles of human dignity and non discrimination in order to provide the ground for the development of individual and social personality. which is now mentioned as a fundamental right even in international instruments. the observance of this right requires the recognition and the need to respect this right in the constitution. therefore, in this study, we explain the rights of citizenship in the constitution of the islamic republic of iran with emphasis on international documents.method: the research method in this article is descriptive analytical which has been done by studying books and articles.findings: the constitution of the islamic republic of iran, emphasizing the principle of separation of powers and functional independence of power institutions and emphasizing the principles of equality, justice, security, god’s sovereignty and ensuring the full rights of the people, is the primary founder of civil rights. and became a group in economic, social, political and cultural aspects.conclusion: explaining and recognizing social, economic, and political rights in the constitution as the rights of its people is one of the requirements of the rights contained in international documents. the right is subject to other regulations.
