مطالعه حقوقی چالش های فراروی جامعه بین المللی در اِعمال سازکارهای جهانی نظام بین المللی حقوق بشر

زمینه و هدف: پیرو فجایع دردناک بشری در جنگ جهانی دوم، توجه جامعه بین‌المللی به سوی حمایت از حقوق بین‌الملل‌بشر معطوف گشت. در این خصوص تصویب اعلامیه جهانی حقوق بشر به عنوان نقطه عطفی در حمایت از حقوق بین‌الملل‌بشر تلقی گردید و تصویب چندین سند حقوق‌بشری دیگر را در سطح جهانی با خود به همراه‌داشت. این اسناد به منظور ارتقا حقوق بشر، نظارت بر اجرای مقررات حقوق‌بشر و رسیدگی به موارد نقض آن حقوق، یک سری سازکارهای جهانی نظیر نهادهای مبتنی بر منشور و نهادهای ناشی از معاهدات را ایجاد و اختیاراتی به آن‌ها تفویض نموده‌اند. سازکارهای مزبور هرچند در زمینه اجرای موثرتر موازین حقوق‌بشری مندرج در اسناد بین‌المللی عملکرد خوبی داشته‌اند اما در عمل با چالش‌هایی مواجه هستند. بدون تردید شناخت این چالش‌ها می‌تواند حمایت مطلوب‌تر از حقو‌‌ق‌بشر در جامعه بین‌المللی را به دنبال داشته‌باشد. روش: موضوع حاضر، با روش توصیفی تحلیلی و با عنایت به گردآوری اطلاعات عمدتا کیفیِ تحقیق به روش کتابخانه‌ای و به صورت استفاده ازاسناد،کتاب‌ها، مقاله‌ها و تارنماهای معتبر مورد کندوکاو قرار گرفته‌است.یافته‌ها و نتیجه‌گیری: مطالعات حقوقی نشان می‌دهد که سیاسی بودن در شورای حقوق‌بشر، نادیده‌گرفتن مقررات بین‌المللی حقوق‌بشری توسط دولت‌ها در کمیساریای عالی حقوق‌بشر، نبود ضمانت به منظور پاسخگویی دولت‌ها در اجرای توصیه‌‌ها و استانداردهای حقوق‌بشری در سطح داخلی در کمیسیون مقام زنان و یافتن سرپناه برای پناهندگان در کمیساریایی عالی ملل متحد برای پناهندگان از مهم‌ترین چالش‌های پیش‌رو نهادهای مبتنی بر منشور هستند. همچنین نهادهای ناشی از معاهدات نیز با چالش‌هایی نظیر عدم هماهنگی، محدودیت منابع، افزایش تعداد اسناد و غیره مواجه هستند.

challenges of the international community in applying the international mechanisms of the international human rights system

background and purpose: following human painful disasters in the second world war, the attention of the international community was focusing on protecting human rights. in this regard, the adoption of the universal declaration of human was considered as a milestone in protecting human rights and leading to the adoption of several other human rights instruments in world level. these instruments for the promotion of human rights, the monitoring on the implementation of human rights and consider situation of violation of those rights, created a series of executive mechanisms in the world dimension and have given them powers. although these mechanisms have had a good function in the context of the more effective implementation of human rights standards included in international instruments. method: the present topic has sought by descriptive analytical method and with regard to collecting mainly qualitative research information by library method and in the form of using documents, books, authoritative articles and related websites.findings and conclusion: legal studies show that politicization in the human rights council, disregard for international human rights regulations by states in the high commissioner for human rights. lack of guarantee for states accountability in implementing the recommendations and standards of human rights at the domestic level in the commission onthe status of women and finding refuge for refugees at the united nations high commissioner for refugees are the most important challenges facing charter based bodies. charter based bodies also face challenges such as lack of coordination, resource constraints, increasing the number of documents, and so on.
