مطالعه تطبیقی ضمانت اجراهای کیفری از حقوق مالکیت صنعتی

زمینه و هدف: بحث ضمانت کیفری از حقوق مالکیت صنعتی از موضوعات محل بحث و نظر است، زیرا از یک سو به دلیل برجسته تر شدن کیفرزدایی در نظام‌های حقوقی و از سوی دیگر ضرورت حمایت از مالکیت صنعتی نوعی تعارض و تناقض ایجاد شده است. استفاده نظام حقوقی ایران از ضمانت اجرای کیفری در برخی از مصادیق حقوق مالکیت صنعتی، سبب شده است به منظور ارزیابی رویکرد مورد اشاره در حقوق ایران به بررسی تطبیقی به حقوق دیگر کشورها از جمله فرانسه و آمریکا پرداخته شود. روش: مقاله حاضر توصیفی تحلیلی بوده و با استفاده از روش کتابخانه ای به بررسی موضوع مورد اشاره پرداخته است.یافته‌ها و نتیجه‌گیری: نتایج بیانگر این امر است که استفاده از ضمانت‌های کیفری در حقوق فرانسه و آمریکا نیز مطرح بوده و در راستای حفاظت از مالکیت صنعتی از ضمانت اجرای کیفری بهره می‌برند، اما نوع و میزان مجازات‌های تعیین شده با حقوق کیفری ایران متفاوت است. بدین معنی که مجازات‌های تعیین شده عمدتاً نقدی است و نقدی بودن جرایم صرفه اقتصادی ارتکاب جرم تا حد زیادی از بین می‌برد. البته در حقوق فرانسه و آمریکا نیز از مجازات حبس استفاده می‌شود، اما نسبت به حقوق ایران به مراتب کمتر است.واژگان کلیدی: حقوق مالکیت صنعتی، ضمانت کیفری، مجازات، حبس، جزای نقدی.

comparative analysis of the status of industrial property rights in iranian, french and american law

background and aim: the issue of criminal guarantee of industrial property rights is one of the topics of discussion, because on the one hand due to the more prominent impunity in legal systems and on the other hand the need to protect industrial property has created a kind of conflict and contradiction. the use of the iranian legal system to guarantee criminal enforcement in some cases of industrial property rights, has led to a comparative study of the laws of other countries, including france and the united states, in order to evaluate the approach mentioned in iranian law.method: the present article is an analytical descriptive study using the library method.findings and conclusion: the results indicate that the use of criminal guarantees is also considered in french and american law and in order to protect industrial property, they use the guarantee of criminal execution, but the type and amount of penalties are different from iranian criminal law. this means that the penalties imposed are mostly monetary, and the monetary nature of economically viable crimes largely eliminates the commission of the crime. of course, imprisonment is also used in french and american law, but it is much less than in iranian law.
