ارزیابی حقوقی تحریم‏های هوانوردی ایالات متحده آمریکا علیه ج. ا. ایران از منظر نظام بین المللی حقوق بشر

زمینه و هدف: ایالات متحده آمریکا خارج از قطعنامه‏های شورای امنیت، بطور یکجانبه اقدام به تحمیل تحریم‏هایی در حوزه‏های مختلف، خاصه حوزه هوانوردی، علیه بسیاری از کشورها از جمله جمهوری اسلامی ایران نموده است. تحریم در صنعت هوانوردی، ایمنی؛ اساسی‏ترین عنصر و نیاز مبرم این صنعت را مورد چالش قرار می‏دهد و به تبع آن آثار جدی بر ژئوپولوتیک منطقه‏ای می‏گذارد. پژوهش حاضر تحریم‏های هوانوردی ایالات متحده علیه ایران در پرتو موازین حقوق بین‏المللی بشر و تاثیر آن بر ژئوپولتیک هوانوردی غرب آسیا را مورد ارزیابی قرار می دهد.روش شناسی: پژوهش حاضر با استفاده از روش توصیفی تحلیلی انجام شده است.یافته ها و نتایج: در مورد تحریم‏های هوانوردی با توجه به ارتباط مستقیم ایمنی هوانوردی با حق حیات، حق امنیت، حق برسلامتی و حق برتوسعه به مثابه حق‏های بنیادین حقوق بشری که بواسطه اعمال تحریم‏های هوانوردی امریکا بر ایران به طور قطع نقض گردیده، تردید جدی نسبت به مشروعیت تحریم‏ها وجود دارد و حقوق بین‏الملل بشر محور که داعیه‏دار حفظ حقوق انسانی است را با چالش جدی مواجه می‏نماید. افزون بر آن، این تحریم‏ها سبب شدند تا ایران نتوانند از فرصت‏هایی که ناشی از موقعیت ژئوپولتیک هوانوردی منطقه می‏باشد، به خوبی بهره‏مند شود.

background and purpose: the united states has unilaterally imposed aviation sanctions on many countries, including iran, outside of un security council resolutions. the aviation sanctions challenge safety, which is the most essential element of aviation industry and consequently it has serious effects on regional aviation geopolitics. in this article, us aviation sanctions against the islamic republic of iran in the light of international human rights principals and impact do these sanctions have on aviation geopolitics in west asia.method: the authors made these findings using a descriptive analytical method.finding and conclusion: the direct relationship of the aviation safety with “right to life”, “right to security”, “right to health” and “right to development”, as fundamental human rights,  that have been definitively violated by the us aviation sanctions on the iran, there are serious doubts about the legitimacy of these sanctions and it poses a serious challenge to international human rights. in addition, these sanctions prevented iran from taking full advantage of the opportunities arising from the aviation geopolitical situation in the region; west asia.
