مفهوم «جانشینی دولت ها در زمینه تعهدات ناشی از ارتکاب اَعمال متخلفانه بین المللی»: مطالعه تطبیقی آموزه های حقوقی و رویه محاکم بین المللی در گذار زمان

جانشینی دولت ها در زمینه مسئولیت بین المللی به عنوانِ پیامدی از جانشینی مطرح است که بنیان آن به تعهدات ناشی از ارتکاب اَعمال متخلفانه بین المللی بازمی گردد. در رویکرد سنتّی، عدم جانشینی بر چنین تعهداتی، اصل دانسته شده که نتیجه مستقیم و عملی آن، فقد مسئولیت دولت جانشین است. جستار حاضر، از رهگذر کنکاش و مطالعه تطبیقی منابع فرعی حقوق بین الملل (آموزه های حقوقی و آرای قضایی و داوری بین المللی) که ابزار شناخت منابع اصلی هستند، پی به تحول مفهومی آن، در گذر ادوار، برده و نشان داده که رویکردی نوین در مقابل گفتمان سنتّی شکل گرفته است و آن، اصل بودن جانشینی بر چنین تعهداتی است. نگرش سنتّی، متاسی از «واقعیت» و رویکرد نوین، بیشتر، متاثر از «حقیقت» است. پژوهش پیش رو، در رویارویی با تِز و آنتی تِز یادشده، سَنتِزی را مطمح نظر قرار می دهد که با آن بشود از معایب هریک احتراز کرد؛ رویکردی بینابین که مطلق و محض بودن، محلی از اِعراب نیابد.

Foundation of “State Succession to Obligations Arising from the Commission of Internationally Wrongful Acts”: Legal Doctrines and International Judicial Decisions in Passing the Ages

Succession of states in respect of international responsibility is considered as a consequence of succession, which is referring to obligations arising from the commission of internationally wrongful acts. In traditional thoughts, nonsuccession to such obligations has been recognized as a rule that its strict and functional result is the lack of  responsibility for successor state. Comparative study of subsidiary sources of international law (legal doctrines and judicial decisions) as the means for the determination of main sources, the present paper figured out its conceptual evolution, during the ages and showed that modern thoughts against the classic one has been raised and that is the rule of succession to such obligations. The classic attitude is barsed on the “reality” and the other is affected by the “truth”, more. Facing the mentioned thesis and antithesis, this paper considers the synthesize makes it possible to avoid any disadvantages; The sober attitude far away from absoluteness and entireness.
