مهاجرت کاری زنان و حمایت‌های کنوانسیون کار شایسته برای کارگران خانگی

مهاجرت بین‌المللی پدیده‌ای در حال رشد است که اکثر کشورهای جهان را تحت تاثیر قرار می‌دهد. از آن جا که مهاجران تبعه کشور پذیرنده نیستند، در برابر نقض حقوق بشر آسیب پذیرند و هنگامی که وارد کشوری می‌شوند، اعم از آن که ورود آن ها قانونی یا غیرقانونی باشد، شاهد نادیده گرفتن حقوق خود در مقایسه با اتباع آن کشور هستند. این در حالی است که حقوق بشر باید برای همه افراد بشر، صرف نظر از موقعیت مهاجرتی آنان رعایت شود. در این میان، کارگران زن مهاجر موقعیت حساس‌تری دارند. زنان کارگر مهاجر به دلیل داشتن ویژگی های جنسیتی و مهاجرتی که عمدتا شغل های کم درآمدی دارند و در مشاغل خانگی مشغول می‌شوند ، از حمایت‌های ناچیزی برخوردارند. مضاف بر آن که استثمار و شرایط کاری نامساعدی را تجربه می کنند. بنابراین جلوگیری از سو استفاده ،تبعیض و حمایت از گروه های آسیب پذیر ضروری است. از این رو سازمان بین‌المللی کار در ادامه سایر معاهدات بین المللی موجود، با وضع کنوانسیون کار شایسته برای کارگران خانگی و ایجاد تضمینات رویه‌ای و نظارتی در جهت احترام، حمایت و ایفای حقوق بشر کارگران زن مهاجر تلاش می‌کند. هدف از این مقاله، بررسی آسیب‌پذیری کارگران زن مهاجر و تحلیل ابعاد حقوقی حمایت‌های کنوانسیون کار شایسته برای کارگران خانگی است.

women's work migration and the protection ofthe convention on decent work for domestic workers

international migration is a growing phenomenon that affects most countries in the world. because immigrants are not nationals of the host country, they are vulnerable to human rights abuses and when they enter a country, whether their entry is legal or illegal, they see their rights being disregarded compared to citizens. at the same time, human rights must be respected for all human beings, regardless of their immigration status. meanwhile, migrant female workers are in a more sensitive position. immigrant working women have little support due to their gender and immigration characteristics, are suffering from mainly low‌paying jobs and domestic work. in addition, they experience exploitation and unfavorable working conditions. therefore, prevention of abuse, discrimination and protection of vulnerable groups is essential. the international labor organization, in continuation of other existing international treaties, strives to establish a convention on decent work for domestic workers and to establish procedural and supervisory guarantees in order to respect, protect and fulfill the human rights of migrant women workers. the purpose of this article is to examine the vulnerability of migrant women workers and to analyze the legal aspects of convention on decent work for domestic workers.
