مردان و واگذاری وکالت در طلاق: پیامدها از منظر صاحب نظران

ازآنجایی که مساله وکالت در طلاق ازجمله معضلات جامعه امروزی ما بوده و طی سالهای اخیر افزایش یافته و کانون مقدس خانواده را متزلزل کرده است پژوهش حاضر با هدف دست‌یابی به «پیامدهای واگذاری شرط توکیل در طلاق از جانب مردان» به منزله‌ی یک پدیده‌ی اجتماعی انجام شده است. داده‌های مورد نیاز این پژوهش با رویکرد کیفی و تکنیک مصاحبه نیمه ساختاریافته گردآوری و با روش تحلیل مضمون تحلیل شده است. با توجه به ملاحظات نظری، واگذاری وکالت مرد در طلاق تمام ابعاد حیات آنان را تحت‌الشعاع خویش قرار داده، ضمن اینکه می‌تواند مثبت یا منفی تلقی گردد. بسترهای درخواست اخذ شرط از منظر مصاحبه‌شوندگان حقوقی، فرهنگی اجتماعی بوده و براساس یافته های تحقیق، کارشناسان عواملی مانند اطاله ‌دادرسی قضایی، برداشت فمینیستی، شکل‌گیری منیّت در زندگی، ناکامی‌های حقوقی، قدرت‌طلبی، بی‌اعتمادی اجتماعی، ضرورت‌های اجتماعی، بزرگ‌منشی متظاهرانه، ناامنی روحی و خودتنظیمی در زندگی را از جمله بسترهای شکل دهنده این پدید می‌دانند. همچنین نتایج تحقیق نشان می‌دهد که پیامدهای مثبت معطوف به مردان از دیدگاه کارشناسان، واگذاری شرط در ازای بذل مهریه که دِین مرد تلقی می‌گردد، بسیاری از مشکلات را حل می‌نماید. همچنین آثار منفی معطوف به مردان، فروگذاری تعهد اقتصادی، اقتدارزدایی خاموش، تله‌رهاشدگی، مخفی‌کاری و تظاهر اخلاقی، ناامنی روانی و محدودیت‌بخشی است.اﮔﺮﭼﻪ ﺑﻪزﻋﻢ اﮐﺜﺮﯾﺖ ﺻﺎﺣﺐﻧﻈﺮان اﯾﻦ ﺷﺮط ﭘﯿﺎﻣﺪ ﻣﺜﺒﺘﯽ ﺑﺮای ﻣﺮدان ﻧﺨﻮاﻫﺪ داﺷﺖ و از اﻗﺘﺪاری ﮐﻪ در اﺳﻼم ﻫﺴﺖ ﻣﻤﺎﻧﻌﺖ ﺑﻪ ﻋﻤﻞ ﻣﯽآورد، وﻟﯿﮑﻦ از ﻧﮕﺎه ﺑﺮﺧﯽ واﮔﺬاری ﺷﺮط ﺑﻪ ﻧﺤﻮ ﻣﻄﻠﻖ و ﯾﺎ در ازای ﺑﺬل ﻣﻬﺮﯾﻪ ﮐﻪ دِ ﯾﻦ ﻣﺮد ﺗﻠﻘﯽ ﻣﯽﮔﺮدد، ﻣﯽﺗﻮاﻧﺪ ﺑﻌﻀﯽ از ﻣﺸﮑﻼت را ﺣﻞ ﻧﻤﺎﯾﺪ.

Men and Delegation in Divorce: Consequences from the Point of View of Experts

۱۰۶۸/۵۰۰۰ The present study was conducted with the aim of achieving the consequences of divulging the tax condition on the part of men as a social phenomenon. The data needed for this study was collected by qualitative approach and semistructured interview technique and analyzed by thematic analysis method. According to theoretical considerations, the assignment of the rights of the husband to divorce all aspects of their life, and can be regarded as positive or negative. The conditions for requesting the condition from the perspective of legal interviewers are social and based on the findings of the research, experts have identified factors such as judicial review, feminist conception, the formation of life in man, legal failures, power struggle, Social trust, social necessities, supreme magnanimity, spiritual insecurity and selfregulation in life constitute one of the foundations of this formation. Also, the results of the research show that positive outcomes toward men from the point of view of experts, the assignment of a condition in exchange for a dowry that man’s religion conveys, solves many problems.
