تبیین عدل الهی در تشریع احکام حقوقی جنسیتی از دیدگاه مفسران فریقین

آفریننده نظام هستی در آفرینش بشر از دو جنس اهدافی داشته است، چنان‌که در تشریع احکام و تعیین خط مشی زندگی زن و مرد نیز اهدافی را دنبال نموده است که در راستای غایت خلقت، هدایت و سعادت آنها می‌باشد. مقاله حاضر به روش توصیفی تحلیلی به دنبال تبیین عدل الهی در تشریع احکام حقوقی جنسیتی از دیدگاه مفسران فریقین است. در میان احکام الهی، که برای نیل بشر به هدایت مطلوب او تشریع شده، برخی از احکام نظیر: شهادت، ارث، دیه و ... دارای اختلاف جنسیتی است. در دوره‌های مختلف، برخی مغرضانه یا از سر نادانی، این اختلاف در میان احکام جنسیتی را مورد نقد قرار داده‌اند و آن را با عدل تشریعی در احکام، متناقض ارزیابی نموده‌اند. در این نوشتار، با بررسی دلایل تشریع این احکام، عدل الهی در وضع آنها بررسی گردیده و تناقض آن با عدل تشریعی، مردود دانسته شده است.

there was a goal behind the creation of two gender for human beings by creator of the world. as he followed a purposes in the legislation of laws and appointing a line for life of men and women which are along side with the aim of creation, guidance and prosperity. current article by analytical descriptive method aims to explain divine justice in legislation of gender-based legal laws from the view point of commentators of two sects. among divine laws -which have been legislated for achieving human beings to the guidance- some of them like: testimony, inheritance, blood money and so on, have gender difference. someone in different times whether deliberately or ignorantly examined this gender difference and estimated it as a contradiction with legislative justice (of allah) in the laws. in this writing, divine justice in making laws has been considered through examining the evidences of legislation of these laws, so it had been understood that contradiction of that with divine justice is not acceptable.
