فلسفه حکم عده در غیر طلاق رجعی و وفات

موضوع تحقیق حاضر بررسی علت حکم عده، در غیر طلاق رجعی و وفات است تا در منظر این تحقیق، علیت اختلاط نسب و استبرای رحم در حکم این عده، ثابت و ثمرات این علیت، در حکم عده زنانِ متصف به استبرای رحم، مترتب شود. مشهور فقیهان با توجه به اغراضی که در عده زنان اعم از وفات و طلاق و غیر آن، بر می شمارند و بعض این اغراض منصوصه هستند، مناط مطرح در ذیل برخی روایات، که لزوم عده را به جهت اختلاط میاه و عدم عده را به دلیل استبرای رحم معرفی می کرد، حکمت دانسته و به استناد عمومات ادله، در غیر محل نص، حکم به لزوم عده کرده اند. در مقابل، برخی فقیهان با توجه به برخی روایات، علیت مناط پیش‎گفته را پذیرفته و در بعض فروع فقهی، ثمرات این علیت را مترتب کرده اند. از آنجا که این نفی و اثبات، به طور مطلق بوده، به باور نویسنده، وجود بعض تعبیرات از نصوص عده، مثل «انما العده من الماء»، «ان اخرج الماء اعتدت»، «فلاستبراء الرحم من الولد» دلالت بر علیت دو مناط پیش‌گفته کرده و ثمرات علیت مترتب می شود. ولی در عده طلاق رجعی و وفات، آن دو مناط، بخاطر وجود دلیل خاص، حکمت خواهد بود.
