تحلیلی بر معیار «کمک به توسعه اقتصادی دولت میزبان» برای تحقق مفهوم قراردادهای سرمایه‌گذاری تحت کنوانسیون داوری ایکسید

کنواسیون ایکسید در حل و فصل اختلافات سرمایه‌گذاری به دلائل متعدد، تعریفی از قراردادهای سرمایه گذاری ارائه نمی دهد که این وضعیت سبب شده رویه قضایی در پرونده های متعدد داوری سرمایه گذاری بین المللی سعی در تبیین قیود مرتبط با احراز قراردادهای سرمایه گذاری نماید. در این مسیر، معیار «کمک به توسعه اقتصادی دولت میزبان»، در میان مراجع داوری به عنوان بحث برانگیزترین این معیارها تلقی شده است. اینکه چرا این معیار نتواسته به طور یکنواخت در مراجع داوری بین المللی اعمال شود و چگونه می توان از حذف آن در رویه داوری جلوگیری کرد، موضوع تحلیل های ارائه شده در این پژوهش است. مطالب ارائه شده در این پژوهش که با روش کتابخانه ای و با ابزار فیش برداری انجام شده نشان می دهد در مواجهه با مشکلات متعدد مرتبط با این معیار، از یک طرف ضرورت توجه به شیوه های نوین سرمایه گذاری و از طرف دیگر اتخاذ رویکردی انعطاف پذیر برای تحقق الزامات این معیار ضروری است.

an analysis on the criterion assistance to the economic development of the host state for realizing the concept of investment contracts under the icsid arbitration convention

introduction the icsid arbitration court is considered the most successful international arbitration institution in this field in settling investment disputes between capital governments and investors, which has created numerous procedures since its establishment.one of the most important established procedures is around the concept of ((investment contract)).the icsid convention has not provided a definition of investment contracts in article 25, which has caused the arbitration procedures in many cases to try to explain the limitations related to the confirmation of investment ontracts.in this regard, one of the most important criteria was presented in the case of salini against the moroccan government, in which several restrictions are considered for the approval of an investment, one of the most controversial of which is the criterion (assistance to the economic development of the host state) that since its introduction, it has been the subject of many discussions among academics and judges, and in fact, it is the most challenging restriction among the restrictions presented in the salini case.investigating this important issue, why the important criterion ((assistance to the economic development of the host)) cannot be applied uniformly in international arbitration courts and how to avoid its removal in the arbitration procedure, is the subject of the analysis presented in this article.
