بررسی چالش‌های وارد به قول مشهور در سن بلوغ و تقویت نگاه کیفی و عقلایی به ادله سن بلوغ

در این نوشتار به بررسی یکی از مباحث پرچالش فقهی و حقوقی یعنی سن بلوغ می‌پردازیم. در این موضوع، مشهور فقهای شیعه از دیرباز مستند به ادله قطعی، فتوا به بلوغ دختران در 9 سالگی و پسران در 15 سالگی داده‌اند. برخی اندیشه‌های فقهی و حقوقی در صدد نقد این مبنا برآمده و آن را از حیث ادله لفظی و غیر لفظی به چالش کشیده‌اند. لکن این چالش‌ها با رویکرد فقه جواهری مورد نقد و تحلیل قرار گرفته و در نهایت، همان قول مشهور فقهای شیعه تثبیت شده است. لکن در مقام نظریه‌پردازی و با رعایت موازین فقه سنتی، نگاه جدیدی به ادله سن بلوغ نموده و دیدگاه کیفی و عقلایی را تقویت می‌نماییم.

Studying the Challenges on the Famous Opinion about Puberty and Strengthening the Qualitative and Logical Look to the Reasons of Puberty

In this note it is investigated one of the jurisprudential and legal challengeable issues i.e. puberty. From the early times the wellknown jurists based on definite proofs have issued fatwa for puberty in girls beginning in the age of 9 and in boys beginning in the age of 15. Some of the jurisprudentiallegal thoughts have planned to criticize this base and have challenged it with respect to verbal and nonverbal evidences. But these challenges with the approach to Fiqhe Jawaheri have been criticized and analyzed and at the end the opinion of the wellknown Shia jurists has been approved. But at the position of theorization and with observing traditional fiqh standards a new look to the proofs of puberty has been formed and the qualitative and reasoning opinion has been strengthened.
