نقش حق وثیقه در سیاست‌گذاری‌های اقتصادی و سیاسی ایران، به دلیل تاثیر عمیق آن بر روابط اقتصادی، موضوعی حیاتی و بحث‌برانگیز است. این تحقیق به بررسی این مسئله می‌پردازد که چگونه سیاست‌گذاری‌های دولتی می‌تواند بر حق وثیقه‌گذاری افراد اثر بگذارد و در عین حال چه توازنی می‌تواند میان منافع دولتی و حقوق فردی برقرار شود. سوال اصلی پژوهش این است که آیا سیاست‌های اقتصادی و مالی دولت باعث محدودیت‌هایی در حق وثیقه افراد می‌شود و آیا این محدودیت‌ها می‌تواند به تقابل منافع دولتی با حقوق فردی بیانجامد. فرضیه تحقیق بر این مبناست که سیاست‌های اقتصادی و مالی دولت در برخی موارد منجر به تضاد با حقوق افراد در بهره‌مندی از مالکیت و آزادی اقتصادی آن‌ها می‌شود. در این تحقیق، با استفاده از روش تحلیلی-توصیفی و مطالعه قوانین و مقررات موجود، نتیجه‌گیری می‌شود که تقابل میان منافع دولتی و فردی در زمینه وثیقه‌گذاری، نیازمند بازنگری سیاست‌ها و وضع مقررات حمایتی است تا تعادل میان حقوق فردی و منافع ملی تضمین شود. یافته‌های تحقیق می‌تواند به سیاست‌گذاران کمک کند تا قوانین جدیدی تدوین کنند که منافع دولتی و حقوق افراد را هم‌زمان در نظر بگیرند.

the role of collateral rights in iran's economic and political policymaking is a crucial and contentious issue due to its profound impact on economic relations. this study investigates how government policies influence individuals' right to collateral while exploring the balance that can be established between state interests and individual rights. the primary question is whether governmental economic and financial policies impose restrictions on individuals' collateral rights and if these restrictions result in conflicts between state interests and individual rights. the hypothesis suggests that, in certain cases, state economic policies lead to a clash with individuals' rights to ownership and economic freedom. through a descriptive-analytical method and an analysis of existing laws and regulations, this study concludes that the conflict between state and individual interests in collateral requires policy revisions and supportive regulations to ensure a balance between individual rights and national interests. these findings can aid policymakers in drafting new legislation that concurrently considers state interests and individual rights.
