سه نظریه فقهی در مبنای مشروعیت دولت در فقه سیاسی شیعه

با پذیرش ضرورت تشکیل دولت اسلامی، بحث از چگونگی حجیت و مشروعیت دینی آن نیز اجتناب ناپذیر می شود؛ در میان صاحب نظران و علمای دین، دیدگاه‌های مختلفی در مبنای مشروعیت دینی دولت به معنی نظام سیاسی مطرح است. در میان اهل سنت، نظریه های مختلفی همچون: «قهر و غلبه»، «استخلاف»، «میراث» و «اجماع» به عنوان اصلی ترین نظریه ها در تبیین مبنای مشروعیت نظام اسلامی مطرح هستند و در میان علمای شیعه نیز سه نظریه اصلی و مهم «انتصابی محض»)الهی) «انتخابی وکالتی»(مردمی) و «جمع»(الهی- مردمی) در مبنای مشروعیت فقهی نظام سیاسی مطرح می باشد. سوال اصلی این پژوهش این است که وجه تمایز و دلایل فقهی این سه دیدگاه متفاوت در میان علمای شیعه چیست. در واقع، هر کدام از این دیدگاه ها چه مبنایی را برای مشروعیت دینی دولت به رسمیت می شناسند و چرا. در واقع اهمیت این پژوهش از این باب است که مشروعیت دینی اصلی ترین سرمایه اجتماعی نظام های دینی در بقا و کارآمدی آنان است که بدون تامین آن، حیات و ثبات این نظام ها با تهدید جدی مواجه می شود. ما در این نوشتار در پی تبیین و بررسی این سه نظریه شیعی از جهت ادله فقهی آنها هستیم.

three shiite jurisprudential theories on the islamic legitimacy of a political systemabstractscholars including religious scholars hold differing views on the islamic legitimacy of a political system. among sunni scholars, theories of “brute force”, “nomination”, “inheritance”, and “election” are mostly agreed upon in this regard and shiite scholars, early and late, believed in three principal and important jurisprudential theories such as appointment, election, and consensus on the matter of islamic legitimacy for a political system. the question we ask in this paper is what are the differences and rationales for these differing shiite scholarly perspectives and in fact what do each of these theories see as the basis for the legitimacy of a government in islam, and why? in this research, we examine and clarify these three important theories in terms of their jurisprudential arguments.
