یک قرن اندیشه؛ نگاهی به سنت یکصدساله نگارش کتب حقوق جزا

این مقاله به بررسی تطور کتب حقوق جزا در ایران از ابتدای قانونگذاری مدرن تا به امروز می‌پردازد. مسئله اصلی نحوه تاثیرگذاری بستر تاریخی و اجتماعی بر تحول اندیشه‌های حقوقی در کتب حقوق جزا بوده و بر این اساس ارائه تحلیلی کلی از سیر تطور کتب این رشته از علم حقوق را هدف گرفته است. بدین منظور این مقاله با بهره گیری از روش تحلیل گفتمان و هرمنوتیک زمینه گرا در کنار هم، با تاکید بر بسترهای تاریخی و اجتماعی به بررسی این سنت نگارش این کتب و چهارچوب های آن در دوره پیش و پس از انقلاب اسلامی ایران می پردازد. نتایج پژوهش نشان می‌دهد که علیرغم تفاوت های ناشی از تغییر شرایط سیاسی و اجتماعی در این دوران و با وجود تفاوت در سلایق نویسندگان این کتب، ساختار کلی حاکم بر این کتب در این دو دوره دچار تغییری بنیادین نگشته و سنت نگارش آنان تا به امروز امتداد یافته است.

the thought for a century: a look at the hundred-year tradition of writing of criminal law books

this article examines the evolution of criminal law books in iran from the inception of modern legislation to the present day. the main issue is how historical and social contexts have influenced the development of legal thought in criminal law books, with the goal of providing an analysis of the progression of these texts. utilizing discourse analysis and context-oriented hermeneutics, the study focuses on the examination of these books in both pre- and post-revolutionary periods, emphasizing the historical and social contexts. the results of the research indicate that despite differences arising from changing political and social conditions and the preferences of the authors, the overall structure of these books has not undergone a fundamental change and the tradition of their writing has continued to this day.
