بازخوانی عدالت در اندیشۀ جان رالز (با تاکید بر عدالت جنسیتی)

جان رالز درجایگاه یکی از نظریه‌پردازان قرن بیستم در نظریۀ «عدالت» دو اصل «آزادی» و «تفاوت» را تبیین کرده است و درنهایت، اصل «فرصتِ برابر» را برای همۀ افراد جامعه پیش‌نهاد می‌دهد. در این تحقیق با استفاده از منابع کتاب‌خانه‌ای و با به‌کارگیری روش توصیفی تحلیلی اصول عدالت جان رالز بررسی شده است و ضمن مقایسۀ آن در چهارچوب عدالت جنسیتی براساس آموزه‌های اسلامی مورد نقد و واکاوی قرار گرفته است. گاهی تصور می‌شود که در زمینۀ مسائل زنان با استفاده از نظر رالز می‌توان در تشریح اصل تفاوت تعریف جدیدی از عدالت جنسیتی در جهان غرب ارائه داد، اما در این تحقیق مشخص شد که شیوۀ پذیرش اصل تفاوت رالز و اولویتی که میان اصول عدالت خویش قائل است، بیان‌گر این معناست که از نظر او بین برابری جنسیتی و عدالت جنسیتی تفاوتی نیست. بر این اساس، ضمن تحلیل نگرش یادشده کیفیت عدالت جنسیتی منطبق بر اصول دوگانۀ رالز بررسی شده ‌است. نتایج این تحقیق نشان می‌دهد که براساس جهان‌بینی اسلامی می‌توان به‌نحو بارزتری به دغدغه‌های موجود در زمینۀ عدالت به‌طور عام و عدالت جنسیتی به‌طور خاص پاسخ داد؛ به‌گونه‌ای‌که بتوان نیازهای ویژۀ گروه‌های اجتماعی هم‌چون زنان را تامین کرد.

Rereading Justice in John Rawls’ Thought with an Emphasis on Gender Justice

John Rawls, as one of the twentiethcentury theorists in his theory of justice, explains the two principles of freedom and the principle of difference, and ultimately proposes the principle of equal opportunity for all the people of the community. In the present study, using library resources and applying a descriptiveanalytical method and comparing them in the framework of gender justice, the principles of justice of John Rawls were criticized and analyzed on the basis of Islamic studies. Sometimes, it is believed that in the context of women’s affairs, it can be argued that in describing the principle of difference, a new definition of gender justice in the Western world can be presented; however, the method of accepting the principle of the Rawls’ difference and the priority that prevails over the principles of justice itself was discussed. It makes no difference between gender equality and gender equity. Accordingly, while analyzing this attitude, the quality of gender justice is aligned with Rawls’ dualistic approach. The results of this research show that, based on the Islamic worldview, one can more clearly respond to the concerns of justice in general and gender justice in a specific way while ensuring respect for justice, the particular situation and the special needs of social groups Like women.
