اعتباریات و نقد نظریۀ حقیقی‌بودن گزاره‌های علوم انسانی با تاکید بر فقه و حقوق

اعتباریات پایۀ علوم انسانیِ اسلامی است، درصورتی‌که نگاه جامع و فلسفی به آن داشته باشیم و آن را جزئی از مباحث وجودی بدانیم. درواقع، انسان موجودی تکوینی و حقیقی است که امور خود را در زیست دنیوی و با زبان اعتبار بیان می‌کند. بنابراین، اعتباریات رابطۀ تنگاتنگی با انسان‌شناسی و معرفت‌شناسی دارد و به این علت است که پایۀ علوم انسانی قرار می‌گیرد. به این دلیل است که گزاره‌های علوم انسانی، ازجمله گزاره‌های فقهی و حقوقی، اعتباری به شمار می‌روند، نه حقیقی و برهان در این علوم جایگاهی ندارد. آن‌چه در این علوم مهم است، جلب منفعت و دفع ضرر و کسب کمال و سعادت است و در علوم انسانیِ اسلامی رسیدن به قرب الاهی است، اما کسانی که گزاره‌های فقهی و حقوقی را حقیقی می‌دانند خلط بین تکوین و تشریع کرده‌اند، زیرا رابطۀ واقعی در جایی است که رابطۀ علت و معلول برقرار باشد، اما در مسائل فقهی و حقوقی حکمی با جعل شارع و قانون‌گذار اعتبار شده است و هیچ منشا تکوینی‌ای ندارد، بلکه مقررات شرعی یا عرفیِ قانونی است که وضع شده است.

Credibility and the Critique of the Theory of the Veritable Nature of Human Sciences with Emphasis on Jurisprudence and Law

The theory of conventions is the basis of Islamic humanities, if it is viewed from a philosophical and holistic perspective and taken as part of existential discussions. In reality, humans are genuine and real beings that express their needs in this world through the language of conventions. Therefore, conventions are intertwined with anthropology and epistemology and act as the pillars of Islamic humanities. Propositions in the humanities including propositions in jurisdiction and law are conventions and do not necessitate proofs. What is important in these sciences is to attract benefits and dispose loss and gain perfection and prosperity, and in Islamic humanities the aim is to reach closeness to Allah. But, those who take jurisprudence and legal propositions as genuine have mixed genesis and decree since genuine relationships exist in areas where there is a relationship between cause and effect. In jurisprudence and legal issues, a law is validated through a judge and has no genesis, and religious or customary laws are taken from the validity of the judge or a legislator.
