بررسی انواع قراردادهای تامین مالی پروژه های بخش انرژی با تاکید بر تامین مالی از طریق عواید پروژه

انتخاب مناسب‌ترین روش برای اجرای طرح‌های زیربنایی، همیشه از مهمترین دغدغه‌ها و نگرانی‌های دولت‌ها، مخصوصاً دولت های در حال توسعه بوده است. یکی از موارد و موضوعات اساسی در زمینه‌ی پروژه‌های نفتی، نحوه‌ی تامین سرمایه‌ی لازم جهت اجرای پروژه‌های مزبور است. با توجه به این که، شرکت‌های بین المللی نفتی ، یا شرکت ملی نفت ، چگونه و از چه طریقی در تامین سرمایه‌ی لازم جهت اجرای طرح‌های نفتی خود اقدام می‌کنند، نتایج و آثار مالی آن نیز، بالتبع، متفاوت خواهد بود. تاکنون روش‌های متنوعی به این منظور، طراحی و در موارد بسیاری اجرا شده است. به طور کلی، تامین مالی به دو بخش تقسیم می شود: تامین مالی شرکتی و تامین مالی پروژه‌ای. در این مقاله سعی بر آن است که به بررسی قالب های قراردادی تامین مالی پروژه ای با نگاهی به صنعت نفت و گاز و همچنین نگاهی گذرا به قانون تشویق و حمایت سرمایه گذاری خارجی و آیین‌نامه اجرایی آن جهت جذب سرمایه گذار خارجی برای طرح‌ها و پروژه های در کشور پرداخته شود

choosing the best method for implementing infrastructure projects is always the main concern of governments, especially the governments of developing. one of the main issues in the field of oil projects is the supply of capital for these projects. according to the international oil companies and national oil companies, how and in what way will attempt the funds required for the implementation of oil projects, outcome and financial effects also, consequently, will be different. up to now, various methods have been implemented for this purpose. in general, financing is divided into two parts: corporate financing and project financing. in this paper is paid to examine the contractual terms of financing a project looking at the oil and gas industry as well as a quick look at the foreign investment promotion and protection act (fippa) and its implementing regulations to attract foreign investment for projects in the country
