تحلیل فقهی قدرت نرم نهاد مرجعیت شیعی با تاکید بر شئون دوگانه فتوا و حکم

نقش سیاسی، اجتماعی مرجعیت و علمای دینی خصوصاً شیعه در تاریخ جوامع اسلامی همواره نقشی برجسته و تعیین‌کننده بوده است. این نقش در حالتی تکلیف‌مدارانه جهت حفظ استقلال سیاسی، اقتصادی و فرهنگی جوامع اسلامی و ایستادگی در برابر طمع‌ورزی بیگانگان همواره بر صحنه تاریخ جوامع مسلمان و به ویژه تشیع نقش بسته است. مرجعیت شیعی در جامعه اسلامی به عنوان نیرویی ریشه‌دار، پرتوان، متکی به معنویت، برخواسته از متن اجتهاد و مسلح به ابزار فتوا و حکم با توانایی بسیج مردم و ایجاد جنبش سیاسی اجتماعی و راهبری آنها را به نحو مستقیم و غیرمستقیم دار یکی از مهمترین کانون‌ها و نهادهای قدرت نرم فقه سیاسی شیعی می‌باشد.ما در این مقاله ضمن بررسی جایگاه مرجعیت دینی به عنوان یکی از منابع مهم قدرت نرم در نظام فقه سیاسی اسلام به دو مولفه مهم آن، که خود نیز منبع قدرت نرم می‌باشند می‌پردازیم.رویکرد ویژه در این مقاله بررسی فقهی جایگاه و شئون دوگانه فتوا و حکم می‌باشد.

Jurisprudent Investigation of the soft power of authority institution with the emphasis on dual aspects of Fatwa and sentence

Politicosocial role of religious authority and especially Shiite scientists, in the history of Islamic societies has always been prominent and determinative. This role is illustrated in the historical scene of Islamic and especially Shiite societies, in a taskoriented status and for the protection of political, economic and cultural independence of Islamic societies and resistance in front of the foreigners’ greed. Shiite authority, having the instrument of Ijtihad in the two aspects of Judgment and sentence, as the two important components of power, not only breaks the grandeur of colonialism and arrogance and cuts their interference in the internal affairs of other countries, but also carries an explicit message to human societies, putting stress on the establishment of justice and divine teachings, the right of freedom integrated with human responsibility in front of God, fighting all exponents of ruin and corruption that weaken the status of peace and security, paying attention to multidirectional rights of man’s children from any race and religion, negation of foreign arrogance in political, economic and social areas, the right of defense to the assault, supporting the world’s Moslems and oppressed, and etc.In the present paper, the status of religious authority as one of the important sources of power in Islamic Fiqh system and its two important components which are themselves sources of power, are investigated. The especial approach in this jurisprudent study is these status and components.
