تفکیک «جرم» و «تخلف» در بزه قاچاق کالا و ارز: مبانی، ضوابط و آثار

قانونگذار در ماده 44 قانون مبارزه با قاچاق کالا و ارز اقدام به تفکیک موارد جرم و تخلف قاچاق از یکدیگر نموده است و رسیدگی به جرایم را در صلاحیت دادگاه انقلاب و رسیدگی به تخلفات را در صلاحیت سازمان تعزیرات حکومتی قرار داده است. قانونگذار در این قانون به ظاهر دنبال اتخاذ راهبرد جرم زدایی بوده است. در این مقاله با روش توصیفی تحلیلی به بررسی انتقادی راهبرد جرم زدایی اتخاذی قانون‌گذار پرداخته شده است. هر‌چند قانونگذار در ماده 44 با ضوابطی در صدد تبیین مرز جرم و تخلف قاچاق از یکدیگر بوده است، لکن تفکیک صورت گرفته از جهت احکام و آثار حاکم بر این دو قابل پذیرش نیست. چرا که آنچه که در شرایط فعلی تحت عنوان تخلف قاچاق در قانون پیش‌بینی شده است، در واقع رفتارهای مجرمانه‌ای است که در صلاحیت مراجع اداری قرار گرفته است.

in article 44 of the law of combat against smuggling of goods and currency, the legislator has separated the cases of crime and infringement of smuggling from each other. apparently, in this law, the legislator sought to adopt the strategy of decriminalization. in this article, the adoption strategy of the legislator has been critically examined by descriptive analytical method. the separation made between crimes and infringements is not acceptable due to the rules governing them. as a result, in the current situation, what is prescribed in the law as the infringement of smuggling, is actually criminal behavior that is under the jurisdiction of the administrative authorities.
