الگوی مطلوب پاسخ‌دهی به جرائم اطفال و نوجوانان؛ مطالعة موردی دادگاه اطفال و نوجوانان شهرستان یزد،سال 1401

پاسخ‌دهی به جرائم اطفال و نوجوانان با در نظر گرفتن شرایط جسمی، روحی و خانوادگی آنان، نقش موثری در بازدارندگی و جلوگیری از تکرار جرم دارد. الگوهای متفاوتی در این رابطه وجود دارد. هدف از پژوهش حاضر، شناسایی بهترین الگو برای پاسخ‌دهی به جرائم اطفال و نوجوانان است. بدین منظور از میان الگوهای موجود، الگوهای رفاه، عدالت کیفری، حداقل مداخله، عدالت ترمیمی و مدیریت خطربررسی شده است . داده‌های این تحقیق از طریق منابع کتابخانه‌ای و با مطالعة 100 پرونده از دادگستری یزد جمع‌آوری‌شده است. بررسی این داده‌ها به روش توصیفی- تحلیلی نشان می‌دهد که الگوی حداقل مداخله، الگوی غالب این پرونده‌ها بوده است. به نظر می‌رسد که دادگاه کیفری اطفال باید برای صدور حکم، از الگوی پاسخ‌دهی ترکیبی استفاده کنند که مجموعه‌ای از شاخص‌های مفید الگوهای مختلف را در بردارد.

the ideal model of responding to children and adolescents’ crimes; a case study of the juvenile court of yazd city, iran, 2022.

responding to the crimes of children and adolescents by considering their physical, mental and family conditions has an effective role in deterring and preventing the repetition of crimes. there are different models in this regard. the purpose of this research is to identify the best model of responding to the crimes of children and adolescents. for this purpose, welfare models, criminal justice, minimum intervention, restorative justice and risk management models have been examined. the data of this research has been collected through library sources and by studying 100 cases from the yazd judiciary. examining these data using a descriptive-analytical method shows that the model of minimum intervention is the dominant model of these cases. it seems that the juvenile criminal court should use a combined response pattern to issue a verdict, which includes a set of useful indicators of different models,
